described in the approved preliminary mitigation plan and final mitigation plan developed <br />for the Marshland Mitigation Site. <br />24. The mitigation plan must be implemented prior to the issuance of occupancy permits for <br />the Homebase project. All elements of the mitigation plan shall be in place and <br />functioning, including the Marshland Mitigation project to address wildlife function and <br />value. The stormwater detention and water quality treatment portion of the on -site <br />mitigation shall be constructed simultaneously with construction of the retail facility. <br />25. A wetland monitoring plan must be submitted with the final wetland mitigation plan. The <br />plan shall include performance goals for created wetlands, as well as provisions for <br />evaluation of enhanced wetlands and buffers. Wetland monitoring shall be conducted <br />annually for five (5) years following completion of wetland mitigation. The results of <br />wetland monitoring investigation shall be submitted to the Planning Department in the <br />form of annual reports (one report submitted in the fall of each monitored year.) The <br />report shall be prepared by Wetland Resources or another wetland biologist approved by <br />the City, and the biologist shall certify whether the performance goals are being met and <br />if not, recommend specific corrective actions necessary to achieve performance goals. <br />Subject to approval by the City, necessary corrective actions must be made by the <br />Applicant. <br />26. In order to property determine revegetation success, vegetation shall be monitored <br />annually for the proposed wetland mitigation site. It is best to sample vegetation in <br />summer, between mid -June and mid -August, when most species can be ea:.iiy identified. <br />Photographs shall be taken from the beginning of the construction operation through the <br />completion of the monitoring process. Permanent points shall be established after <br />construction is completed and marked on the wetland map. Points shall be located in <br />each vegetation community type Photos shall be taken at these points at the same time <br />each year during optimal vegetation growth. Photographs will supplement vegetation <br />cover and basal area data in determining if the vegetation component of the mitigation <br />plan is performing satisfactorily. <br />27. Wildlife monitoring shall be performed by visual observations on a seasonal basis. Any <br />mammal or bird tracks or other signs of wildlife shall be recorded at each visit to the <br />newly created wetland and enhanced wetland. <br />28. In addition to the monitoring program, a contingency plan shall be developed in the event <br />of identified mitigation shortfall such as plant mortality (20% plant mortality). An <br />agreemen! between the applicant and the City of Everett shall be reached before <br />implementation of the contingency plan. The contingency plan shall identify corrective <br />actions which will be implemented if the vegetation goals are not met. <br />29. The wetland mitigation site shall be maintained in April and June of each year for the five <br />year monitoring period. Maintenance shall include, but not be limited to, the removal of <br />competing grasses and non-native vegetation (by hand if necessary), irrigation, <br />fertilization (if necessary), replacement of plant mortality, and the replacement of mulch <br />for each maintenance period. <br />30. The applicant shall provide a performance security bond in the amount of 300 percent of <br />the estimated cost of implementing the Final Wetland Mitigation Plan prior to the <br />EXHIBIT #I E <br />rAGc..f_GF I3 <br />
