issuance of Public Works and Building Permits. This bond is payable to the City of <br />Everett in order to ensure that 1) all costs for construction, monitoring, maintenance, and <br />contingencies will be met during the monitoring period; and 2) contingency actions, <br />including plant replacement, can be carved out over the five year monitor ng period. <br />Subject to the City's approval of the monitoring report, the performance security bond <br />shall be released by the City at the conclusion of the five year monitoring period if the <br />Applicant's wetland biologist certifies that the performance goals for the created wetlands <br />have been met. If contingency measures are required at the end of the five year <br />monitoring period, the Bond shall be retained for an additional two year period, or until <br />corrective actions have been made by the Applicant <br />31. The 50 foot set back from the Marshland Canal shall be graded on a 2% slope with <br />surface drainage running toward the Canal. Spoils from the maintenance/excavation of <br />the Canal will be piled within the 50 foot setback and left to dry for a period not to exceed <br />six months. The spoils will be removed from the 50 foot setback within the six month <br />period and spread on portions of the Spane Farm not protected as part of this mitigation <br />project. <br />Noise <br />32 All engines and engine -driven equipment shall be equipped with adequate mufflers, <br />which shall be properly sized and maintained to prevent excessive or unusual noise. <br />33. Noise from construction activities that are exempt from Everett's maximum permissible <br />noise level standards shall be restricted to the hours between 7 a.m. and 10 p.m. during <br />weekdays and 8 a.m. and 8 p.m. on weekends and holidays. <br />34. Noisy equipment must be shielded or enclosed, and quieter equipment should be used <br />where possible. <br />35. Construction equipment must be turned off during prolonged periods when not in use. <br />36. Stationary, noise -emitting equipment shall be located away from receiving properties <br />whenever possible. <br />Land Use <br />37. All landscaping, setback, and parking requirements established by the Everett Zoning <br />Code shall be satisfied. <br />38. All signs on the retail site shall meet the applicable Zoning Code standards for the B-2 <br />zone. Any request for a sign that does not meet these standards shall be considered by <br />the Planning Director through a Comprehensive Design Plan permit process, or by the <br />Board of Adjustment through a variance procedure. <br />EXHIBIT # s <br />rAGcfa—Or-/3 <br />
