The criteria as set forth in EMC 19.7.020.K reads �n <br />part as follows: <br />The Hearing Examiner, using the review process described in <br />EMC Title 15, Local Review Procedures, may allow detached <br />access�ry f>uildings to exceed 15 feet in height, or to exceed <br />1,000 square feet in area as provided i�erein. The Hearing <br />Examiner �hall have the authority to deny an apolication for <br />accessory buildings which exceed 15 feet in height or a total <br />of 1,OOU square feet The basis for denial is incompatibility <br />with the dwelling andlor neighborhood character. To make <br />this determination, the Hearing Examiner may look to such <br />factors that include, but are not lirnited to, view obstruction, <br />aesthetic impact on surruunding propert�es and streetscape, <br />incompatible scale with dwellings on surrounding properties, <br />and impact on neighborhood character. The Hearing <br />Examiner shall also have the authority to impose greater <br />setback requirements, landscape buffers, or other locational <br />or design requirements as nece�sary to mitigate the impacts <br />of accessory buildings which are larger or taller than <br />othenvise allowed bv this section. <br />In addition 10 the above criteria, the Ordinance also regulates detached garages. <br />For the instant projecf, the relevant regulations 3re: <br />(1) On lots containing a minimum fot area of 18,000 square <br />feet, the Hearing Examiner may allow the total square <br />footage of all accessory buildi�gs, including both <br />attached and detached accessory structures, to exceed <br />1,000 squa-e feet, subject to all of the following <br />requirements: and <br />(2) The total square foatac�e of all accessory huilding(s), <br />whether attached or detached, shall �iot exceed 15 <br />percent of the lot area; ar.d <br />(3) The footprint of all delached ar,cessory building(s) shall <br />not exceed the square footaye of the lesser of: <br />(a) tlie square footage of the footprint of the <br />dwelling together evith up to 500 square feet of <br />its attached garags , if any; or <br />(b) 2,000 square feet; and, <br />(4) Detached accessory buildings exceeding the size <br />limi;ations of Subsection B of this section shall not be <br />�I� <br />
