The <br />existing duplex was constructed in 1979 with its front yard <br />and front building setback orientation toward 21st Street S.E. <br />Criterion No 2- <br />That the variance will not be materially detrimental to the property in the <br />area of the subject property or to the City as a whole. <br />a• End�gin �•0 The applicant has stated that the variance will not <br />be detrimental to the property in the area of 3215 21st Street <br />S.E. or the City as a whole because it is an improvement to <br />the existing structure and neighborhood. <br />b• Con 1 ucionc• Verbal testimony fiom the property owners at <br />2026 and 2025 State Street opposing the variance request was <br />given at the hearing. <br />Criterion No. <br />3• <br />That the variant will only grant the subject property the same general <br />rights enjoyed by other property in the same area and zone as the subject <br />property. <br />a• En— din�,E: The applicant has stated that most of the other <br />homes in the area only have a 5 foot setback requirement on <br />the north property line. <br />b.
