15. The landscaping, buffering, and screening of the building and site as proposed by <br /> the Applicant are reasonable. The modification of the landscaping requirements <br /> allowed pursuant to EMC 19.35.070 includes 15 feet of lanciscaping with a single <br /> row of evergreen trees and vines instead of the dense Type II Landscaping <br /> required. The proposal is reasonable in light of the needs of the facility. The <br /> modification will allow screening, while at the same time provide security. (frnding of <br /> faCt#?.i') <br /> 16. No significant nuisance irritants, such as noise, smoke, dust, odor, glare, visuel <br /> blight, or other undesirable impacts, will be generated after construction of the <br /> proposed project. (finding of facf#2fJ) <br /> 17. The proposal is consistent with the Everett General Plan and in particular, the <br /> public facility designation. Policy 1.7.2, which requires public facilities to be sited <br /> and developed to be compatible with adjoining land uses, has been considered and <br /> revi�wed. The proposal is consistent with the policy. <br /> 18. The facility is located in an area that can serve the citizen of Everett. It is on land <br /> which is available and has historically been used for tho juvenile justice system. <br /> Policy 1.7.4 of the Everett General Plan is satisfied. <br /> 19. The proposal is consistent with the development standards for R� zones, with the <br /> exceptions as requestea. The project has also been reviewed pursuant to State <br /> regulations, including SEPA. (finding of iact#10) <br /> 20. Public transportation, i�cluding public transit, is available. (finding of fact#29) <br /> 21. The criteria for non�onformirig uses are listed above. The same conclusions for <br /> the Special Property Use Permit that have been addressed apply for the non- <br /> conforming use and are adopted as part of these conclusions. <br /> 22. The Planning Department of the City of Everett established setbacks for the <br /> proposed siructure. The setbacks identified in the site plan are reasonable and <br /> have not been objected to by the Applicant. <br /> 12 <br />
