DECISION <br /> Based upon the preceding findings of facts and conclusions, testimony and evidence <br /> submitt�d at the public hearing, and upon the imprsssions of the Hearing Examiner of a <br /> site view, it is hereby ordered that the requested approval of a Special Property Use Permit <br /> for the demolition of the existing Denney Youth Center and the construction of a new <br /> 110,000 square foot, 100-bed juvenile justice facility at 2801-10th Street, Everett, <br /> Washington, is granted. In addition, the requested expansion of the existing Non- <br /> Conforming Use Permit for the aliowance of the facility in the R-4, Multiple-Family High <br /> Density Zone is granted. Also, the requestod modifications from the landscaping <br /> requirements from the required Catego�y B Landscaping Standards are granted. All these <br /> permits are granted subject to the foilowing conditions: <br /> 1. Building setbacks shall be in conformance with tne conceptual site plan on file with <br /> the Hearing Examiner. At a minimum, the following setback standards shall be <br /> adhered to: <br /> a. Front lot line, abutting 10ih Street- 10 feet <br /> b. Side lot line, abutting Pine Street- 150 feet <br /> c. Side lot line, abutting Multiservice Ctr.- 10 feet <br /> d. Rear lot line, abutting Multifamily Housing- 35 feet <br /> 2. Building height shall be limited to a maximum of 55 feet. The maximum height of <br /> the north facade shall be 35 feet above existing grade. <br /> 3. Exterior lighting shall be located and shielded in such a mar�ner as t� not produce <br /> residual glare on abutting properties, particularly those properties located north and <br /> east of the project siie, <br /> 4. Based on the Everett Police Department's review of the site plan, the "sally-port" <br /> entry shali be mndified from a drive-in/back-up configuration to a drive-though <br /> configuration with pedestrian drop-off. 7he Applicant shall contact Captain Jim <br /> Couture of the Police Department at 259-0485. <br /> 5. Detailed drawings in accordance with City Design and Construction Standards shall <br /> be submitted to the Public Works Department showing site parkin� layout, <br /> landscaping, utilities, storm drai�age, temporary construction erosion control, and <br /> all required improvements in the public right-of-way. Public Works Department <br /> approval of these drewings is required prior to any permits being issued. All <br /> improvements shall be completed, approved, and warranted before Occupancy <br /> Permits are issued. <br /> 6. The Applicant shall provide curb ramps at the intersection of 9th Street and Pine <br /> Street �nd at 10th Street and Pine Street. <br /> 13 <br />
