AMENDMENT NO. TWO (2) TO <br /> PROFESSIONAL SERVICES AGREEMENT <br /> BETWEEN <br /> THE CITY OF EVERETT AND GEOENGINEERS, INC. <br /> LARIMER ROAD AT WOOD CREEK <br /> The City and GeoEngineers agree to amend and modify their professional services agreement dated <br /> February 28,2007 and Amendment No. 1 as follows: <br /> WHEREAS, the City and Consultant entered into an agreement for consulting services dated February <br /> 28,2007 (hereinafter referred to as the"Agreement"); <br /> WHEREAS, the Agreement expires on 31 December 2008 and the project design will extend into <br /> 2009; <br /> WHEREAS, the City and Consultant agree to amend the Agreement to extend the time for completion <br /> from 31 December 2007 to 30 June 2009; <br /> NOW,THEREFORE,the City and Consultant agree to amend the Agreement as follows: <br /> A. Paragraph 3 of the Agreement, Time of Beginning and Completion of Performance, is <br /> amended to read as follows: <br /> "This Agreement shall commence as of the date of execution of this Agreement and <br /> shall be completed by 30 June 2009." <br /> B. Additions to the budget, Exhibit B, and reimbursables, Exhibit C, to include geotechnical <br /> engineering consultation and observations during construction in accordance with the <br /> attached budget estimate. <br /> C.
