AGREEMENT <br /> THIS AGREEMENT,entered into this January 1,2009,is between the City of Everett,a <br /> municipal corporation,under the laws of the State of Washington,hereinafter referred to <br /> as the"City,"and the Everett Rowing Association,hereinafter referred to as the <br /> "Association." <br /> The parties agree as follows: <br /> 1. Purpose. This Agreement describes the parties' understandings and responsibilities <br /> regarding the promotion of the sport of rowing in Everett. It memorializes the <br /> working relationship regarding fees,scheduling,use of facilities,maintenance, safety, <br /> regattas,and other requirements,necessary to provide a high quality rowing program <br /> for the Everett community and the general public in the City of Everett. Both parties <br /> will strive to provide a high quality,safe, competitive and recreational rowing <br /> program with appropriate conduct and good sportsmanship. <br /> 2. City Responsibilities. The City's Everett Parks and Recreation Department("Everett <br /> Parks")responsibilities are as follows: <br /> a. Grant the Association priority in scheduling of rowing activities. The City and <br /> Association shall approve in advance scheduling of cooperative rowing activities. <br /> b. Schedule classes for the general public in consultation with the Association. <br /> Everett Parks will pay the Association the following registration percentages of <br /> all registration fees collected by Everett Parks for recreational rowing classes <br /> offered through Everett Parks and instructed by the Association: <br /> Year one of contract(2009): eighty(80%) <br /> Year two of contract(2010): seventy five(75%) <br /> Year three of contract(2011):seventy(70%) <br /> c. Provide access to the Langus Riverfront Park shelihouse by any Association <br /> member the Association Executive Director designates,provided that the City <br /> may deny access to a member if it has reasonable cause. In such case,the Everett <br /> Parks and Association's representatives will discuss the matter. <br /> d. Provide space for storage of rowing related equipment,and maintenance supplies <br /> at the shelihouse. The City may provide additional space as available for rowing <br /> activities if requested by the Association. Use of additional indoor space will <br /> require an amendment to this agreement. <br /> e. Provide recreation assistance regarding rowing operations. <br /> f. Provide all locks and keys to be used at the shellhouse. Everett Parks will notify <br /> the Association when the keys are issued. Association agrees to pay the standard <br /> deposit.Association agrees not to duplicate these keys,may be required to pay for <br /> any re-keying that occurs as a result of the Association missing keys.
