36. A pedesuian circulation system for the site must be approved by the Planning Director and Traffic <br />Engineer prior to the issuance of any building permits. Walkways must allow pedestrians and <br />wheelchairs to gain easy access from sid�walks and bus stops to building entrances through the use <br />of paths which are physically separated from vehicle tra�c and man�uvering areas. <br />37. Placement and screening of refu;e disposal area must be shown on the site plan and provided per <br />Section 39.080 of the Zoning Code. <br />38. Any rockeries or retaining walls proposed in required setbacks shall not be over 36" in height and <br />must be in conform;+,nce with Section 39.150 of the Zoning Code. <br />39. Building setbacks must be a minimum of 20 feet in the front (eastern property line), 20 feet in the <br />rear (western property line), and 10 feet on the interior sides (north and south property lines). The <br />appiicant has sought a setback modification for the north, south and western property lines to <br />accommodate the cons;ruction of individual decks (REVII #04-009). The City of Everett Planning <br />C::par;ment feels the deviation from the setback requirement is warranted, as it will enhance the <br />single family residential nature of the site while providing additional recreational space for residents <br />on site. <br />40. The height limit for all structures on site shali be a maximum of 28 feet. <br />41. Landscaping must be provided per Section 35 of the Zoning Code. At a minimum this must include <br />the following: <br />a) A landscape strip a minimum of ten feet wide must be provided along the north and south <br />property lines. These areas shall be planted with Type II landscaping. The landscaping may <br />be reduced to five feet to accommodate the deck construction, however the area under the <br />decks should be improved with landscaping as proposed by the applicant. Areas not <br />improved with deck overhangs shall plant to the 10 foot minimum requirement. <br />b) A landscape strip a minimum of 15 feet wide must be provided along the western property <br />line. This area shall be planted with Type II landscaping. The landscaping may be reduced <br />to fourteen feet to accommodate the deck construction, however the area under the decks <br />should be improved with landscaping as proposed by the applicant. Areas not improved with <br />deck overhangs shall plant to the 15 foot minimum requirement. <br />c) A landscape strip a minimum of 20 feet wide must be previded within the front yard setback <br />area along the 7'" Avenue SE. This area would typically be planted with ornamental Type III <br />landscaping, however, the applicant has proposed an alternate landscaping theme for this <br />area as mitigation for the re-orientation of the dwelling units that are adjacent to 7'" Ave SE. <br />Under the modified proposal the applicant proposes to landscape this area with dense Type <br />II landscaping and ornamental fencing to provide a superior streetscape along 7'h Ave SE. <br />The Planniny Director is approving the proposed alternative and aliowing for the units <br />adjacent to 7"' Ave SE to be oriented toward the access road instead of the public street. As <br />a condition of approval, the applicant must provide a detailed plan at the time of building <br />permit submittal that details the treatment of the front yard area subject to the approval of the <br />Planning Director. <br />d) Landscaping shall be provided in the interior of the parking areas for the proposal in addition <br />to the required perimeter landscaping. The areas between the residential units shall be <br />improved to a minimum of Type IV landscaping. <br />
