�--- <br /> • -, , , � <br /> � <br /> � <br /> I <br /> (U) The Contractor agrees to comply with RCW 49.28.020, .060, .110 I �, <br /> prohibiting ihe employment of employees more than eight (8) hours I <br /> in any one day, except in case of emergency, and provided that � <br /> said Contract is terminable in case the Contracto�• shall violate �� <br /> the provisions of such act. i <br /> ( 18) The Contractor ayrees to pay all taxes and assessments aue the ! <br /> State of Washington or any subdivision thereof, and to furnish to <br /> the City a certificate from the Tax Commission of the State of <br /> Washington that all taxes, increase and penalties due from ti�e <br /> Contractcr and all taxes due and to become due with respecr to <br /> such Coni.ract Fiave been paid in full . <br /> (19) ihe Contractor shall , at his own expense, provide flagi�en, shall <br /> furnisY� all siqns, barricades, guards, construction warnings, and <br /> night ligiits in order to protect the public at all times from <br /> inju;,y as a result of his operations. <br /> (2U) The Contractor shall be respunsible for controlling dust and mud <br /> within the project limits. The Contractcr shall be prepared to <br /> use watering trucks, power sweepers and any other pieces of <br /> equipment necessary to avoid creating a nuisance. Al1 roads used <br /> by his operatior� shall be thorouyfily cleaned at tfie end of each <br /> work day. Any damage caused by dust and/or mud shall be the sole <br /> responsibility of the Contractor. <br /> All work required by this Section shall be considered to be <br /> incidental to other items of work, and no extra payment shall be <br /> made for dust and mud control . <br /> (21 ) Any notice froin one party to the other party under the Contract <br /> shall be in writing and shall be dated and signed by the party <br /> giving such notice or by the duly authorized representative of <br /> such party. Any such notice as heretofore specified shall be by <br /> personal delivery thereof or by d�positing same in the United <br /> States Mail , postage prepaid and registered. <br /> (22) In the event a claim shall be filed against the City arowing and <br /> arising out of the performance of the Contract by the Contractor <br /> whether baseless or not, the City shall have the right to retain <br /> from the sum due the Contractor sufficient money to satisfy the <br /> claim until said claim has been withdrawn or dismissed by a court <br /> of competent j�irisdiction. The City shall not be liable for <br /> interest during the period the funds are so held. <br /> (23) The Contractor should carefully examine Rule 171 , issued by the <br /> Washington State Tax Commission, to determine whether or not the <br /> City shall be required to pay a sales tax on the tiaork to be <br /> performed, or shall be exempt from sales tax. In the event the <br /> City is exempt from sales t ,, then the Contractor should be <br /> careful to ascertain the tax plicable to his purchases. <br /> (24) The prevailing rate of wages to be paid to all workmen, laborers, <br /> or mechanics employed in the performance of any part of this <br /> Contract shall be in accordance with the provisions of Chapter <br /> 39.12 RCW, as amended. The rules and regulations of the <br /> Department of Labor and Industries and the schedule or prevailing <br /> wage rates for the locality or localities where this Contract <br /> will be performed as determined by the Industrial Statistician of <br /> the Department of Labor and Industries, ai•e by reference made a <br /> part of this Contract as though fully set forth herein. <br /> Inasmuch as the Contractor will be held responsible for paying <br /> the prevailing wages, it is imper�tive that all Contractors <br /> familiarize themselves tiaith the current t•iage rates before <br /> submitting bids based on these specifications. <br /> 5 <br />� ' -- - - <br />
