20. The proposal is consistent with all City, State, and Federal regulations. <br />(exhibit 1, Palacios testimony) <br />21. Public transit is not provided on-site. However, the Applicant indicated <br />that she will encouraye carpools to help reduce traffic. (Meacham <br />testimony) <br />22. An adjoining property owner submitted that he was in the process of <br />developing his property with single-family residences. He indicated the <br />proposal was compatible, and the Applicant �ill have access to utilities. <br />(Gribble testimony) <br />23. Correspondence was received from a resident (Anton Jackson) who has <br />lived in the neighborhood for approximately 40 years. He was concerned <br />about the protection of the residential nature of the neighborhood and <br />submitted that increased traffic would occur. He contended that the <br />subject property is currently untidy and used for purposes other than a <br />daycare. Included in the uses, according to the witness, is a junk yard <br />that is guarded by three junk yard dogs. (exhibit 6) <br />Jurisdiction: The Hearinn Examiner of the City of Everett has jurisdictional <br />authority to hola a hearing and to issue the decision. That authority is set forth <br />in EMC 2.23.120. Based on the above Findings of Fact, the Hearing Examiner <br />enters the following Conclusions: <br />CONCLUSIONS <br />The Applicant requested approval of a permit for the conversion of an <br />existing family home daycare on property located at 9624-18th Avenue <br />West, Everett, Washington. Upon issuance of the permit it is the intent <br />of the Applir,ank to convert the existing faciiity to a Montessori preschool <br />daycare that tvould accommodate up to 40 children. (�nding 1) <br />2. In order for a Special Property Use Permit to be granted within the City of <br />Everett, the criteria of EMC 19.41.150.0 must satisfied. These criteria <br />are listed in findinp of fact #5. <br />All of the criteria of EMC 19.41.150.0 have been satisfied. The manner <br />in which each criterion is satisfied is set forth in findings 6-21. <br />�� <br />
