4 <br /> AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT <br /> BETWEEN THE CITY OF EVERETT AND <br /> MURRAY, SMITH & ASSOCIATES INC. <br /> This agreement entered into this day of April, 2009 by and between the <br /> City of Everett, a municipal corporation under the laws of the State of <br /> Washington (City) and Murray, Smith & Associates Inc. (Service Provider). <br /> Witneseth: <br /> Whereas the City and Service Provider entered into an agreement September 5, <br /> 2007, entitled "Professional Services Agreement" (Agreement) between the City <br /> of Everett and Murray, Smith & Associates Inc. to provide engineering design <br /> services for Sewer Lift Station No. 24 Replacement Project. <br /> Whereas the City and the Service Provider desire to amend the Agreement for <br /> the purpose of completing remaining engineering work as required by the <br /> Agreement. <br /> Now Therefore, the City and Service Provider do mutually agree to amend the <br /> Agreement as follows: <br /> 1. Paragraph 3 is modified to read as follows: <br /> Time of Beginning and Completion of Performance: This Agreement shall <br /> commence as of the date of execution of this Agreement and shall be <br /> completed by December 31, 2008 July 31, 2009. <br /> 2.
