DECISION <br /> Based upon the preceding findings of facts and conclusions, testimony and evidence <br /> submitted at the public hearing, and upon the impressions of the Hearing Examiner of a <br /> site view, it is hereby ordered that the requested Special Property Use Permit and <br /> Building and Public Works Permits to construct a 28-bed juvenile care transition facility <br /> at 40th Street and Smith Avenue, in the City of Everett, Washington, is granted subject <br /> to the following conditions: <br /> 1. Per Condition #6 of the MDNS (SEPA#51-92), the Applicant shall be <br /> responsible for providing adequate security measures to protect the community. <br /> These measures shall include, but not be limited to, the following: <br /> a. no violent or sexual offenders be eligible for placement at the proposed <br /> Second Chance facility; <br /> b. electronic monitoring of the facility; <br /> c. security alarms on all exterior doors and windows; <br /> d. exterior security lighting of the facility; <br /> e. head counts a minimum of every one (1) hour; <br /> f. facility searches for contraband material on a weekly basis; <br /> g. minimum of weekly urine analysis for each resident of the facility will be <br /> required; <br /> h. twenty-four (24) hour on-duty staffing of the facility; <br /> escorting residents to all appointments until such time as they are <br /> responsible to be in the community without such supervision. <br /> It shall be the responsibility of the Applicant to monitor compliance with these <br /> security measures and provide the Responsible Official with immediate notice of <br /> any noncompliance. <br /> 2. Per RCW 9.94A.030, the following are classified as Violent Offenses: <br /> Any Class A felony <br /> Any attempt, criminal solicitation, or criminal conspiracy to commit a Class A <br /> felony. <br /> *Arson 1 *Assault of a Child 1 <br /> Arson 2 Assault of a Child 2 <br /> *Assault 1 *Murder 1 <br /> Assault 2 *Murder 2 <br /> *Burglary 1 *Rape of a Child 1 <br /> *Child Molestation 1 *Rape of a Child 2 <br /> Extortion 1 *Rape 1 <br /> *Homicide by Abuse *Rape 2 <br /> Indecent Liberties with *Robbery 1 <br /> Forcible Compulsion Robbery 2 <br /> 28 <br />
