DECISION Based upon the preceding findings of facts and conclusions, testimony and evidence submitted at the public hearing, and upon the impressions of the Hearing Examiner of a site view, it is hereby ordered that the requested Special Property Use Permit and Building and Public Works Permits to construct a 28-bed juvenile care transition facility at 40th Street and Smith Avenue, in the City of Everett, Washington, is granted subject to the following conditions: 1. Per Condition #6 of the MDNS (SEPA#51-92), the Applicant shall be responsible for providing adequate security measures to protect the community. These measures shall include, but not be limited to, the following: a. no violent or sexual offenders be eligible for placement at the proposed Second Chance facility; b. electronic monitoring of the facility; c. security alarms on all exterior doors and windows; d. exterior security lighting of the facility; e. head counts a minimum of every one (1) hour; f. facility searches for contraband material on a weekly basis; g. minimum of weekly urine analysis for each resident of the facility will be required; h. twenty-four (24) hour on-duty staffing of the facility; escorting residents to all appointments until such time as they are responsible to be in the community without such supervision. It shall be the responsibility of the Applicant to monitor compliance with these security measures and provide the Responsible Official with immediate notice of any noncompliance. 2.
