CITY OF EVERETT PUBLIC WORKS <br /> SPECIAL PROVISIONS <br /> 2. By conducting a pre-award conference, the City has not thereby waived its right to make <br /> determinations regarding responsiveness and responsibility of the Bidder. <br /> 1.24 ACCEPTANCE OF BID <br /> A. Within 45 days after the opening of Bids, the City will act either to accept the Bid from the <br /> lowest responsive,responsible Bidder, or to reject all Bids. <br /> 1. The City reserves the right to request extensions of such Bid acceptance period. <br /> B. After acceptance by Owner, City's Project Manager, on behalf of Owner, will issue to the <br /> accepted Bidder a written Notice of Award of Contract for the Bid. <br /> 1. Notice of Award of Contract will be delivered in person or by certified mail to the Bidder <br /> whose Bid is accepted. <br /> 2. Notice of Award of Contract will also include a request to furnish a performance and <br /> payment bond and evidence of insurance and to execute the Contract set forth in the <br /> Contract Documents. <br /> C. Notwithstanding delay in the preparation and execution of the Contract, accepted Bidder shall <br /> be prepared, upon written Notice to Proceed, to commence Work within 30 calendar days <br /> following receipt of official written order of Owner to proceed, or on date stipulated in such <br /> order. <br /> D. Bidder has 14 calendar days after receiving the Notice of Award to submit the following <br /> documents to the City: <br /> 1. Two(2)executed copies of the Contract. <br /> 2. Contract bond or equivalent performance and payment bond per Document 007213, Part <br /> 15.2"Bonds", of the Contract Documents. <br /> 3. Certificate of Insurance and additional insured endorsement, Document 007213,Part 15.3 <br /> "Insurance",of the Contract Documents. <br /> E. A Contract shall not be formed until the Contract Documents are signed by the Mayor. <br /> 1.25 TIME OF COMPLETION <br /> A. The Contractor shall complete the Work on or before the date or dates specified in Document <br /> 006013 -Contract. <br /> 1.26 WAGES <br /> A. THIS CONTRACT IS A FEDERAL AID PROJECT AND IS SUBJECT TO THE <br /> DAVIS-BACON ACT AND RCW 39.12.
