Summary: <br />My property has been compromised by the actions of the City of Everett, Snohomish County and t e <br />Washington State Department of Transportation. The right to exclude others from one's property is <br />considered one of the most essential rights of landowners. Taking a person's property to remedy � <br />public problem not created by the person is not legal. FEMA says I am not eligible for flood insurance. <br />I do not live in a flood way or flood plain, but now I live in a land of rising water. This is not of my <br />doine�, but it was caused by development and la�d destniction which has an adverse impact on the <br />environment by •ising the mid-basin for flood hazard control. <br />See: 1993 Entranco EIS/527 Study <br />1934 blocks of SR 527 was not a la d of ris ng wat rYa f ood pla n tor flood way,area of 12600 and 12700 <br />1963 My house and lot (1830 -126th St. SE Everett, WA) was purchased by me irom my parents, and the <br />house was remodeled. Ownership papers were filed in 19G5. <br />1970 Harold Herschlip went t� th� WSDOT, Mr. Mateney, to let the 1NSDOT know that the 7 2 in. cross culvert <br />#9.18 (12600 b�ock of SR 527) was biocked and was not draining properly from the west to east side of <br />the highway. The cross culvert N 9.18 acted as a water equalizer to prevent surface water seep on the <br />west side of the highway from undertnining the roadway bed. The original depth of the privately dug <br />commercial fish pond was 18 feet The east side of the highway culvert was 12 inches above the pond on <br />level land. WSDOT denied responsibility stating the back-up was caused by a dam. There was no dam, <br />but there was a filter to prevent debris from filling and blocking the exit culvert of the pond. <br />1 g71 There was an 18 foot backup on the west side of the highway, due to the biocked cuivert, which caused <br />flooding and the bss of my household contents in the my backyard and basement. Tt�e WSDOT disawwed <br />responsibility. The next week WSDOT placed a 30 inch concentric cuivert with a drilling machine, <br />replacing the blocked 12 inch culvert. The depth of the west sump was 10-12 feet with a width of 10•12 <br />feet at the bottom. The top of it was 25 feet or larger, (cars ianded in the sump area, west side SR 527. <br />especially at night, they accidentally went over the guard rail into the sump) There was no creek on <br />the west side of my property. Debris fill biocking the culvert was caused by highway runoff <br />1975 I purchased the reminder of the property on west side of SR 527 highway. I could not afford the full <br />purchase of the 2.5 acres in 1963. <br />� 9B3 fMom Silve lal:e Lilly Pond while channeli g and�av n�g shou dersW ar unde5ilvc k e e�ln dditio aalGabias <br />Wall was placed on the west side SR 527, (12600 block). <br />Faulty procedures: <br />The channel from 129 St. SE and Silvertake School connects into the cross cu vert <br />#9.18 (12600 block SR 527) with a catch basin placed directly alwve the channel <br />connecting south basin into the cross culvert. It is not acceptable to drain from une <br />basin to another without an easement permit. Six inch barriers were placed on east side <br />of widened highway (SR 527 12600 block ) with 12 foot opening above the culvert to <br />catch basin . South basin highway runoff debris caused filling of the pnnd by 1987 up to <br />approximately 12 inch depth <br />198G Sewers line was installed from south basin to 12600 block. This raised the water table on <br />the west side of highway approximately 4-5 feet. By 198 as rO oodUlas s or bet eWthan/before <br />full. 7he sewer easement agreement was to leave properry 9 <br />sewer placement. Following the sewer placement, I was unable to use SQ to 100 feet of my <br />property, but still had to pay taxes on it. The project destroyed my sump area because of <br />culvert extension. The project also broke my house french drain was f unds and Silverlake <br />Sewer company refused to fix it until a break in french drai� pipe <br />naat�3 A. <br />
