Response to Comments <br />CEMEX Final Supplemental Environmental Impact Statement <br />November 30, 2009 <br />Chapter 4 <br />Soils and Drainage Comments with City Responses <br />Comments are arranged by topic, in chronological order by date received, with most recent <br />listed first. <br />34. Kathy Pierson <br />Snohomish Health District <br />Ms. Pierson has provided a soils report in the possession of the Heath District showing the <br />location on the CEMEX site of approximately 44,031 tons of soils contaminated with Arsenic <br />and Cadmium and an additional 271,253 tons of soil contaminated with elevated PH < 13, a <br />petroleum based contaminant. The noted "inert waste" soils are buried an average of 35 feet <br />below grade, and are located at the north end of the site near the SW corner of the intersection of <br />Glenwood Avenue at Merrill Creek Parkway. <br />In the recent past CEMEX accepted the soils from four public off-site sources and allowed them <br />to be transported to the site for burial and storage, in accordance with State and Health District <br />regulations. <br />At this time the State Departments of Ecology and Natural Resources is aware of these soils <br />being stored on site, and the Snohomish County Health District has issued a permit (Solid Waste <br />Facility Permit #SW -204) to CEMEX for storage of this material. See Appendix A, public <br />comment file, correspondence dated October 6, 2009 from the Heath District. Related <br />documents follow that initial correspondence. <br />Response: The City has been in contact with the Heath District regarding allowed uses at (over, <br />on top of) the contaminated soil storage location and any other details that may be relevant to <br />future use of this specific location and the overall CEMEX site generally, as it relates to possible <br />reuse of the site in the future. There will be conditions / restrictions on what can be built on the <br />material that would have to be reviewed by the Health District and the State Department of <br />Ecology. <br />Chapter 4 — Soils and Drainage Comments <br />23 <br />
