ISSUE - HOURS OF OPERATION <br /> Shockey Appeal - This issue was not appealed. <br /> Neighborhood Appeal <br /> The last issue of the neighborhood appeal states that the <br /> Rubatino facility should have limitations on hours of <br /> operation because of the anticipated impacts on the <br /> surrounding residential properties. <br /> Findings: General commercial uses are permitted in the C-1 <br /> zone. These uses are permitted to operate in the C-1 <br /> without limitations on hours of operation on a consistent <br /> basis. In order to impose this type of restriction, <br /> specific impacts must be identified. The MDNS does not have <br /> any conditions which would limit hours of operation. No <br /> specific impacts which would require a limitation on hours <br /> of operation were identified during the environmental <br /> review. Potential impacts that were could be equated with <br /> unlimited hours of operation include noise, and light and <br /> glare. However, these impacts would be mitigated by the <br /> measures already set forth in the MDNS and required by the <br /> Zoning Code. <br /> Other commercial businesses in the C-i zone are allowed to <br /> operate without restrictions on hours of operation. (In the <br /> past, it has not been the City's policy to regulate hours of <br /> operation for commercial uses. City staff concluded that to <br /> impose this type of restriction would be inconsistent with <br /> requirements as they applied to other uses. ) <br /> Rubatino's existing facility, located at the northwest <br /> corner of California and Harrison, has not generated any <br /> complaints related to hours of operation. This facility <br /> does not normally operate during evening hours or on <br /> weekends. The Applicant has indicated that the proposed <br /> Everett Avenue facility would not operate during evening <br /> hours. <br /> Conclusions: No specific impacts have been identified which <br /> would require imposing limits on hours of operation.
