foot solid wood fence along Everett Avenue, and that this is <br /> excessive mitigation. <br /> Findings: Condition #7 under Mitigation of Adverse Impacts <br /> by SEPA in the MDNS places a limitation on the height of <br /> refuse and recycling containers that may be stored on the <br /> site. It does not specify the type of screening required. <br /> Screening of the containers is, however, addressed in <br /> Condition #11 under, Information for the Developer, in the <br /> MDNS. This condition requires, at a minimum, a six-foot <br /> solid wood fence around the entire site perimeter. In <br /> addition, the MDNS requires additional screening if <br /> containers are stored to a height of 10 feet as proposed. <br /> Additional screening may consist of either a 10-foot solid <br /> fence, or combination of fencing and landscaping. If the <br /> latter option is chosen, the final decision on whether the <br /> proposed screening is adequate would be made by the Hearing <br /> Examiner. <br /> The Applicant proposes storage of containers that are up to <br /> 10 feet in height. The presence of these containers would <br /> constitute a significant visual and aesthetic impact as <br /> viewed from adjacent properties and the public street. <br /> Subsection 41 . 100.B of the Zoning Code requires screening of <br /> all outdoor storage uses. It states, <br /> A solid sight-obscuring fence or other appropriate <br /> screening approved by the Planning Department is <br /> required around the outside edges of the area <br /> devoted to the outdoor use. The height of the <br /> outdoor storage abutting public streets or <br /> residential zones shall not be higher than the <br /> height of the screening device approved by the <br /> Planning Department <br /> The MDNS provides some flexibility with regard to the method <br /> of screening device. The Applicant may choose between <br /> either constructing a fence higher than six feet, or <br /> constructing a six-foot fence in conjunction with <br /> landscaping which will provide a similar degree of <br /> screening. The Applicant may propose a method of screening <br /> within these parameters. <br /> Conclusion: The screening requirements as listed in the <br /> MDNS are clearly stated, and provide some flexibility to the <br /> Applicant by permitting a choice between a six-foot fence <br /> combined with landscaping, or a taller fence which is at <br /> least as high as the containers being stored. The screening <br /> requirements in the MDNS are necessary to mitigate visual <br /> and aesthetic impacts of the proposed use on adjacent <br /> properties and from the public street. The authority to <br /> impose these requirements is provided by Subsection <br />
