The utility facilities will be landscaped and screened to make the <br /> project compatible with other properties. <br /> 13. Utilities cannot be undergrounded. <br /> 14. The variance is required to exceed the height standards for the subject <br /> property. In order for the variance to be granted, the criteria of EMC <br /> 41.130.0 must be satisfied. These criteria have been satisfied. <br /> 15. Because of the location of the pole and the need to serve a portion of <br /> the City of Everett, the site is reasonable. Because of the elevation <br /> being higher than other portions of the City, the variance request is <br /> justified. <br /> 16. The variance will not be detrimental to the property in the area or to <br /> the City as a whole. <br /> 17. The variance will allow the property the same general rights enjoyed by <br /> other properties in the area. <br /> 18. The variance is a minimum variance request. The granting of the <br /> variance is not inconsistent with the goals and policies of the Everett <br /> General Plan. <br /> 19. The variance is not the result of a self-created hardship. <br /> 20. The environmental review of the project has been done separate from this <br /> permit process. <br /> DECISION <br /> Based upon the preceding findings of facts and conclusions, the testimony and <br /> evidence submitted at the public hearing, and upon the impressions of the <br /> Hearing Examiner of the site view, it is hereby ordered that the requested <br /> Special Property Use Permit for the construction of a 126 foot, <br /> self-supporting monopole steel tower for up to 12 cellular panel antennas; the <br /> construction of a 360 square foot maintenance/storage building; and the <br /> placement of a four foot diameter microwave dish at the 90 foot level of the <br /> monopole is granted. In addition, the Applicant is also granted a variance to <br /> allow the height of the monopole to exceed the maximum building height for R-1 <br /> zoned properties. These permits are granted subject to the following <br /> conditions: <br /> 1. Any grading/fill on this site shall be done so as to not impact the <br /> surrounding properties. Any fill within the City must be outside <br /> environmentally sensitive areas and must meet all the requirements of <br /> Chapter 37 of the Zoning Code. <br />
