• <br /> Decision: <br /> The City Council hereby grants the motion filed by Freudenbergs to withdraw the appeal. <br /> SECTION 13: ENGINE TESTING AFTER 10:00 P.M. - MILLER APPEAL <br /> Findings: <br /> • Noise from aircraft engine testing operations are exempt under State and Local noise <br /> ordinances from 7:00 a.m. to 10:00 p.m. <br /> Noises from aircraft in flight are exempt under State and Local noise ordinances at all <br /> times (DEIS, App G -Noise, pg 1-4). <br /> • From 10:00 p.m. to 7:00 a.m. the maximum noise limits under State and Local noise <br /> ordinances for Industrial Sources and Residential Receivers are: <br /> 65 dBA: for up to 1.5 minutes <br /> 60 dBA: for up to 5.0 minutes <br /> 55 dBA: for up to 15.0 minutes <br /> 50 dBA: continuously in any one hour (DEIS, App. G -Noise, pg 1-4) <br /> • The Decision Document includes the following noise mitigation requirements: <br /> In order to minimize the exposure of citizens to the harmful effects of excessive <br /> noise, Boeing shall: <br /> i. Submit to the Responsible Official a detailed professional engineering <br /> design to fill in gaps, raise the height, or otherwise modify berms or <br /> provide new berms. <br /> The design shall be reviewed and approved, and construction completed, <br /> prior to commencement of 777 engine run-up testing. <br /> ii. Locate and select stations for testing to minimize noise impacts. <br /> iii. At the end of one year's engine run-up testing of the 777 model, the <br /> Responsible Official shall direct a noise consultant to undertake an <br /> assessment of the noise impacts. <br /> 21 <br />
