iv. The City shall take steps to strengthen its complaint response procedures, <br /> including designation of the officials to whom complaints shall be directed <br /> throughout the day and night; development of a complaint form; adoption <br /> of procedures for investigation and response. <br /> v. The City shall take appropriate measures to ensure that the 10:00 p.m. to <br /> 7:00 (or 9:00) a.m. ban on testing is strictly enforced. <br /> - Noise - Engine Run-up Testing: (Decision Document, Section V.B.3. (Area 3) pg 30) <br /> • The City of Everett Noise Ordinance requires that the receiving property be located <br /> within the City of Everett (EMC Section 20.08.040). <br /> • In discussion with City of Everett staff, the City of Mukilteo has expressed a willingness <br /> to consider adoption of a reciprocal noise ordinance similar to the City of Everett's Noise <br /> Control Ordinance (EMC Chapter 20.08). <br /> Conclusions: <br /> • The mitigation requirement that Boeing submit a design and construct improvements to <br /> fill in gaps, raise the height, or otherwise modify berms or provide new berms will <br /> mitigate offsite noise impacts, including impacts on the Appellants. <br /> • The City of Everett cannot enforce a violation of its Noise Ordinance based upon a <br /> complaint from a resident of another jurisdiction (e.g. the City of Mukilteo). <br /> Decision: <br /> City staff is to develop a noise complaint response procedure and enforcement procedure specifically <br /> intended to address any aircraft engine testing which occurs between the hours of 10:00 p.m. and 7:00 <br /> a.m. <br /> The Decision Document Condition Number V.B.3(2)v should be modified to read; "the City shall take <br /> appropriate measures to strictly enforce the City of Everett Noise Ordinance for any engine run-up <br /> testing between the hours of 10:00 p.m. to 7:00 a.m." <br /> Affirm the mitigation requirements for physical improvements to the noise berms as set forth by the <br /> Responsible Official in the Decision Document Section V.B.3 (Area 3) 3.b.2 Noise - Engine Run-Up <br /> Testing i. Also, affirm the mitigation requirements for strengthening complaint response procedures <br /> and existing enforcement, Items iv. and v. <br /> 22 <br />
