City staff is to work with Mukilteo and Snohomish County to develop noise regulations, if legally <br /> permissible, which would fill the void in existing noise regulations. <br /> Except as stated, deny the appeal and affirm the Decision Document related to noise mitigation except <br /> as modified herein. <br /> SECTION 14: NOISE MITIGATION <br /> Findings: <br /> • Noise from aircraft engine testing is exempt under State and Local noise ordinances from <br /> 7:00 a.m. to 10:00 p.m. <br /> • With the exception of the provision that the City strictly enforce the limitation of aircraft <br /> engine testing, the noise mitigation requirements included in the Decision Document <br /> which require Boeing "to minimize the exposure of citizens to the harmful effects of <br /> excessive noise" go beyond the requirements of State and Local noise regulations and are <br /> based solely on the City's SEPA authority. <br /> • The Decision Document requires "a detailed professional engineering design to fill in <br /> gaps, raise the height, or otherwise modify berms or provide new berms". The Decision <br /> Document also requires that the design be reviewed and approved by the Responsible <br /> Official prior to commencement of 777 engine run-up testing. <br /> • The intent of this requirement is to reduce noise impacts as much as reasonably possible <br /> through improvements to existing berms or the provision of new berms. <br /> • Under SEPA, mitigation requirements must be "reasonable and capable of being <br /> accomplished" (WAC 197-11-660(1)(c)). <br /> • Noise levels were measured at the Miller Mukilteo residence and are summarized in the <br /> Final EIS: <br /> Non-Boeing noise levels ranged from 41 dBA (birds and distant traffic) to <br /> approximately 70 dBA for local vehicles and aircraft. Boeing aircraft engine <br /> ground run-up noises ranged from 50 dBA (four engines 90%, either aircraft <br /> location) up to 54 dBA (either engine setting, both aircraft simultaneously), with <br /> 53 dBA for two engines. <br /> Approximately 165 days per year levels up to 54 dBA could be heard 11 times <br /> daily from between 12 and 20 minutes each at the residence test locations (1,h1S, <br /> pg 3-51). <br /> 23 <br />
