SECTION 16: BOEING MITIGATION COMMITTEE <br /> Findings: <br /> • Mitigation is assessed by the City of Everett under its authority as provided in state and <br /> local Statutes (WAC 197-11 & Ord. #1348-87). <br /> • Mitigation amounts and conditions are established by the Responsible Official as <br /> authorized and directed in the City's SEPA operating procedures and the statewide SEPA <br /> rules. <br /> • Changes to the mitigation package remain the exclusive responsibility of the City's <br /> Responsible Official throughout the implementation period in accordance with and subject <br /> to State SEPA rules and City SEPA Ordinance. <br /> • The Boeing mitigation introduces unprecedented conditions that were not foreseen when <br /> current City procedures were established. <br /> • The mitigation of impacts resulting from the Boeing Expansion will require coordination <br /> with other governmental entities outside of the City of Everett. <br /> Conclusions: <br /> • The responsibility to impose and subsequently modify mitigation conditions rests with the <br /> City and its Responsible Official. <br /> • Nowhere under SEPA statute, WAC 197-11, or the City of Everett's SEPA Ordinance <br /> No. 1348-87 is there any requirement to establish any interjurisdictional committee. The <br /> City of Everett has chosen to create such a committee in recognition of the unique <br /> circumstances resulting from the Boeing Expansion. <br /> • The City should narrow the focus of the committee, eliminating those activities which <br /> are more properly the exclusive responsibility of the City of Everett and the Responsible <br /> Official. <br /> • The City should expand the membership of the committee to ensure broader representa- <br /> tion. <br /> 27 <br />
