SECTION 16: BOEING MITIGATION COMMITTEE
Findings:
• Mitigation is assessed by the City of Everett under its authority as provided in state and
local Statutes (WAC 197-11 & Ord. #1348-87).
• Mitigation amounts and conditions are established by the Responsible Official as
authorized and directed in the City's SEPA operating procedures and the statewide SEPA
rules.
• Changes to the mitigation package remain the exclusive responsibility of the City's
Responsible Official throughout the implementation period in accordance with and subject
to State SEPA rules and City SEPA Ordinance.
• The Boeing mitigation introduces unprecedented conditions that were not foreseen when
current City procedures were established.
• The mitigation of impacts resulting from the Boeing Expansion will require coordination
with other governmental entities outside of the City of Everett.
Conclusions:
• The responsibility to impose and subsequently modify mitigation conditions rests with the
City and its Responsible Official.
• Nowhere under SEPA statute, WAC 197-11, or the City of Everett's SEPA Ordinance
No. 1348-87 is there any requirement to establish any interjurisdictional committee. The
City of Everett has chosen to create such a committee in recognition of the unique
circumstances resulting from the Boeing Expansion.
• The City should narrow the focus of the committee, eliminating those activities which
are more properly the exclusive responsibility of the City of Everett and the Responsible
Official.
• The City should expand the membership of the committee to ensure broader representa-
tion.
27
