SECTION 23: BOEING MITIGATION PAYMENTS <br /> Findings: <br /> • The schedule of payments provides an immediate payment of $20 million, and <br /> completion of payments, with interest, by 1994. <br /> • Project scheduling makes extensive expenditure of funds on projects in the near-term an <br /> impractical objective. Approximately $8 to $10 million of the initial payment can be <br /> realistically obligated within the first year because of the necessary planning and <br /> engineering work that precedes construction. <br /> • Allocation of State and Local shares for a program this large must be scheduled over a <br /> multi-year period because of the need to shift funding priorities and to correspond to <br /> revenue schedules and governmental procedures. <br /> • A significant early mitigation payment ($20 million) is required by the Decision <br /> Document and substantial annual payments are required in following years. <br /> • The payment schedule in the Decision Document reflects the public scheduling realities <br /> for implementing a large and costly multi-year improvement program. <br /> Conclusions: <br /> • The mitigation payment schedule provides a reliable multi-year source of funding for <br /> major transportation facility improvements that require long term intergovernmental <br /> coordination to complete. <br /> • The Responsible Official's decision is supported by the record, is reasonable, and <br /> conforms with SEPA. <br /> • Appellant's allegations are not supported by the record. <br /> Decision: <br /> Deny the appeal and affirm the provisions in the Decision Document Section VI.A. pages 35-36; <br /> provided, however, the figures on page 35 of the Decision Document shall be changed to read as <br /> follows to provide a total cost of transportation mitigation including interest over the 4-year payment <br /> schedule of$46,107,698 rather than the $47.46 million figure included in paragraph 1 of the Decision <br /> Document on page 35: <br /> 37 <br />
