Mitigation may be provided by a cash payment <br /> to the County, incorporation of recreation facilities in the development, or conveyance <br /> of land to an agency for park and recreation purposes. <br /> Conclusions: <br /> • The Decision Document protects critical environmentally sensitive areas and, where <br /> disturbance of those areas is permitted, compensatory mitigation is required in <br /> accordance with the WAC 197-11-448 which requires a balancing of considerations, and <br /> Section 37 of Everett's Zoning Code which regulates development on or near environ- <br /> mentally sensitive areas. <br /> • City policies and regulations on the protection of environmentally sensitive areas were <br /> applied in a manner consistent with other development proposals. <br /> Decision: <br /> Deny the appeal and affirm the Decision Document with regard to this issue. <br /> SECTION 47: SCHOOL MITIGATION <br /> Findings: <br /> • The EIS analysis considered the impacts of 55,000 people, not households, in the seven- <br /> county study area on schools and school districts. Of these 55,000, approximately <br /> 29,000 are or will be residents of Snohomish County. <br /> • The total new households locating in the Impact Area, as a result of the Boeing <br /> Expansion, will be 22,641 rather than 55,000 which represents the total population <br /> impact on the Impact Area. <br /> • The City's SEPA Policy states that it is the City's objective to: "encourage and approve <br /> development only where adequate public services, including fire and police protection, <br /> are available or will be made available to serve the proposal". <br /> • Residential projects identified by the responsible school district as having a significant <br /> effect on facilities at or beyond capacity have been conditioned by the City to incorporate <br /> voluntary mitigation agreements by the Applicant with the district. This policy is applied <br /> only to residential projects. <br /> • WAC 197-11-510 sets forth responsibilities and procedures for the lead agency to provide <br /> notice to the public of preparation of environmental documents, availability, and <br /> 70 <br />
