hearings. The City of Everett has complied fully with these provisions in carrying out <br /> its SEPA lead agency responsibilities for this action. Notification was provided to the <br /> primary affected school districts. No school districts participated in scoping, commented <br /> on the Draft EIS, or appealed the Decision Document. <br /> • WAC 197-11-545 Effect of No Comment; Subsection (1) states: "If a consulted agency <br /> does not respond with written comments within the time periods for commenting on <br /> environmental documents, the lead agency may assume that the consulted agency has no <br /> information relating to the potential impact of the proposal as it relates to the consulted <br /> agency's jurisdiction or special expertise." <br /> Subsection (2) provides that where such notice has been provided, "Lack of comment by <br /> other [than consulted] agencies or members of the public on environmental documents, <br /> within the time periods specified by these rules, shall be construed as lack of objection <br /> to the environmental analysis..." <br /> Conclusions: <br /> • The record contains no indication of significant adverse impacts on schools or school <br /> districts caused by this project. <br /> • Proper notice was provided to the appropriate agencies with expertise and responsible for <br /> providing educational services to the community in accordance with City policy and State <br /> SEPA rules. <br /> • Absence of scoping involvement, comments on the DEIS, or appeals of the Decision <br /> Document by the affected school districts was construed by the City as a lack of <br /> objection to the information provided and action taken. <br /> • The City appropriately applied its SEPA policies to the Boeing proposal with regard to <br /> school services. <br /> Decision: <br /> Deny the appeal and affirm the Decision Document as written with regard to this issue. <br /> 71 <br />
