CITY OF EVERETT <br /> AMENDMENT NO. 3 <br /> The City of Everett and Rosewater GHD agree to amend and modify their professional services <br /> agreement dated January 16, 2007 (the"Agreement") as follows: <br /> WHEREAS, RoseWater GHD and the City entered into an agreement dated January 16, 2007 to <br /> provide engineering services for the City of Everett Shore Avenue Stormwater Outfall; and <br /> WHEREAS, the City of Everett and RoseWater GHD have experienced delays in working with <br /> Burlington Northern Santa Fe Railroad on the Shore Avenue Stormwater Outfall; and <br /> WHEREAS, the City of Everett and RoseWater GHD agree to amend their Agreement to extend <br /> the time of completion from January 31, 2011 to March 1, 2013; and <br /> WHEREAS, RoseWater GHD is now doing business as GHD Inc. <br /> NOW THEREFORE, the City of Everett and GHD Inc. agree to amend and modify the <br /> Agreement as follows: <br /> 1. References to the Service Provider are amended to read"GHD Inc." <br /> 2. Paragraph 3 of the Agreement is amended to read as follows: <br /> Time of Beginning and Completion of Performance. This Agreement shall commence <br /> as of the date of execution of this Agreement and shall be completed by March 1,2013. <br /> 3.
