. <br /> 1. Review Process II .B: All special property uses shall be <br /> evaluated for the criteria listed in Paragraph C and D of <br /> Sub-section 41.150. The Planning Director shall also have <br /> the discretion to approve a minor expansion of an existing <br /> use which this Ordinance classifies as a special property <br /> use, or to require the proposed expansion to be reviewed <br /> using Review Process III.B. For purposes of this <br /> sub-section, a minor expansion shall be not more than 25 <br /> percent of the land or building gross floor area devoted to <br /> the existing special property use. <br /> 2. Review Process III.B: All special property uses shall be <br /> evaluated for the criteria in paragraphs C and D of <br /> Subsection 41. 150. <br /> 3 . Review Process V.B: Review Process V.B shall be used only <br /> when the special property use is proposed concurrently with <br /> an action which requires review by the Planning Commission. <br /> All such special property uses shall be evaluated for the <br /> criteria listed in Paragraphs C and D of Subsection 41.150. <br /> SECTION 64: Section 41.150.0 of Ordinance No. 1671-89 is amended by <br /> the addition of the following: <br /> 11 . Accessibility to public transit, and traffic reduction <br /> measures proposed by the applicant to reduce dependence of <br /> the proposed use on the automobile. <br /> SECTION 65: Section 41. 160 of Ordinance No. 1671-89 is amended by <br /> the addition of the following: <br /> E. Zoning of Annexations. For properties which the City <br /> Council has accepted a seventy-five (75%) percent annexation <br /> petition or for which the City Council has adopted a <br /> resolution initiating annexation proceedings by election, <br /> the City shall establish zoning and a comprehensive plan <br /> land use designation concurrently with the annexation <br /> proceeding. The zoning and comprehensive plan designation <br /> shall not become effective until such time as the ordinance <br /> annexing the subject properties becomes effective; provided, <br /> however, notwithstanding the above, the City is authorized <br /> to proceed with the annexation independent of the <br /> establishment of the zoning and comprehensive plan <br /> designation when the City Council finds the existence of <br /> extenuating circumstances based upon the general health, <br /> safety and welfare of the area proposed to be annexed and/or <br /> the surrounding area. Whenever the City does not adopt <br /> zoning and a comprehensive plan designation concurrently <br /> with the annexation process, the annexation ordinance will <br /> establish an interim zoning designation of R-S (Suburban <br /> Residential) along with a complimentary comprehensive plan <br /> designation which shall become effective upon the effective <br /> date of annexation and the annexed area shall remain zoned <br /> R-S until such time as the City establishes a different <br /> zoning for the annexed area. <br />
