SECTION 5. Subsection 35.030.B of Ordinance 1671-89, which reads: <br /> B. Expansinns of or Alteratinns to .Existing Uses. The <br /> requirements of this Section shall apply to remodeling or <br /> expansion of existing uses when he value of the new construction <br /> or alteration occurring within a two year period is equal to or <br /> greater than thirty-five ( 35) percent of the assessed value of <br /> the existing structure. Where conformance with this Section <br /> would create a nonconformity of parking standards, the Planning <br /> Director shall determine how the Code is to be applied. <br /> is hereby amended to read: <br /> B. Fxpansinns of or Alterations to Existing Uses. Where conformance with this Section <br /> would create a nonconformity of parking standards or would <br /> conflict with the location of existing buildings on the lot, the <br /> Planning Director shall determine how the Code is to be applied. <br /> In determining how to apply the landscaping requirements in such <br /> circumstances, the Planning Director shall use the following <br /> criteria in deciding which of the landscaping requirements to <br /> adjust, listed in the order of highest importance: <br /> 1. Compliance with street frontage landscaping standards. <br /> 2. Compliance with perimeter landscaping standards. <br /> 3 . Compliance with internal area of parking lot standards. <br /> 4. Compliance with other landscaping standards of this <br /> Title. <br /> SErTTON h: Subsection 38.080.C. 1 of Ordinance 1671-89, as amended <br /> by Section 27 of Ordinance 1729-90, which reads: <br /> C. Lots Mad Nnnronforrâ–ºing by Pnhlir. Ancnisition; Other <br /> Nonconforming Lots. <br /> 1. Any lot which does not conform to the minimum lot area <br /> or minimum lot dimension requirements of this Title as <br /> a result of a portion of such lot being acquired by a <br /> public agency for a public use or purpose, or any lot <br /> which does not conform to the minimum lot area or <br /> minimum lot dimension requirements of this Title which <br /> is not subject to the requirements of Subsection <br /> 39.080.A shall be permitted with: <br /> a. Residential Zones - a single family dwelling <br /> b. Commercial or Industrial Zones: any use permitted <br /> by the zone in which the property is located. <br /> is hereby amended to read: <br />
