1 <br /> REQUEST FOR PROPOSALS <br /> General Contractor/Construction Manager Services for <br /> OFiliEff Water Pollution Control Facility Expansion-Phase C <br /> f.t <br /> • Bonding_Capacity. The Proposer does not provide the City <br /> with evidence sufficient for the City to reasonably conclude <br /> that the firm will be able to provide separate Payment and <br /> Performance bonds for this Project, each in the amount of <br /> 100% of the Total Contract Cost. <br /> • Crimes._ _The Proposer has been convicted of a crime arising <br /> from a previous public contract or the Proposer has been <br /> convicted of a crime of moral turpitude or any felony, <br /> excepting convictions that have been pardoned, expunged <br /> or annulled, whether in this state, in any other state, by the <br /> United States, or in a foreign country, province or <br /> municipality. Proposers shall affirmatively disclose to the <br /> City all such convictions, especially of management <br /> personnel or the Proposer as an entity, prior to notice of <br /> award or execution of a contract, whichever comes first. <br /> Failure to make such affirmative disclosure shall be grounds, <br /> in the City's sole option and discretion, for termination for <br /> default subsequent to award or execution of the contract. <br /> • Bankruptcy. The Proposer files-a petition in bankruptcy, the <br /> Proposer is adjudged bankrupt or insolvent by any court, the <br /> a receiver of the property of Proposer is appointed in any <br /> proceeding brought by or against Proposer, or the Proposer <br /> makes an assignment for the benefit of creditors. <br /> 8.0 CONTENTS OF PROPOSAL AND EVALUATION CRITERIA <br /> Firms shall submit Proposals meeting the following content requirements. The City <br /> reserves the right to request additional information from Proposers. <br /> A. General Proposal Format: Proposals must address each of the evaluation <br /> criteria set forth below in a clear, comprehensive, and concise manner and in <br /> the format prescribed below. In order for the City to adequately compare and <br /> evaluate qualifications and project approach objectively, all Proposals must <br /> be submitted in accordance with the following format in terms of order, should <br /> be clearly separated with tabs, and labeled by response to specific requests <br /> and criteria.
