1 <br /> calls were related to drugs. These contacts are documented in Exhibit 6, five of <br /> which are summarized below. <br /> 52.DD12-6616 — POSSIBLE DRUG LOITERING. On April 10, 2012, Sgt. Bosman was <br /> at the Best Inn to check on its progress toward abating unlawful drug and other <br /> nuisance activity. While there, Sgt. Bosman saw two people sitting in a vehicle who <br /> appeared to be very nervous. Sgt. Bosman approached and judged that both <br /> individuals were under the influence of drugs. He also watched them make quick <br /> furtive movements down by their feet. The two gave conflicting accounts of their <br /> purpose for being at the Best Inn. This behavior is indicative of drug loitering. He <br /> warned both of the consequences of drug loitering but did not feel he had probable <br /> cause to make an arrest. He arrested one of the individuals on a harassment <br /> warrant. <br /> 53.Employee Monitoring. Best Inn employee Peter Kim was on the property during <br /> this incident. He should have recognized two people sitting in a car with no apparent <br /> purpose for visiting the Best Inn as suspicious and called the police. As it happened <br /> the only reason police became involved in this incident was because Sgt. Bosman <br /> happened to be at the Best Inn for other reasons. <br /> 54.Video Surveillance. Surveillance equipment would have deterred the car from <br /> using the Best Inn for probable drug loitering activity and alerted employees to the <br /> suspicious activity. <br /> 55.Illumination. Better lighting of the Best Inn and parking lots would have eliminated <br /> the cover of darkness and deterred the car from using the Best Inn for probable drug <br /> loitering activity. <br /> 56.DD12 — 8545 — POSSIBLE DRUG USE AND DRUG DEALING. On May 7, 2012, at <br /> approximately 11:30 a.m. Officer Nathan Wallace was patrolling the Best Inn parking <br /> lot when he was flagged over by a Best Inn employee to assist with a problem in <br /> room 103. The guests were refusing to leave after their checkout time. Officer <br /> Wallace contacted the guests in room 103 and arrested one of the guests on a <br /> warrant. Officer Wallace also observed evidence of drug use scattered throughout <br /> the room, including a broken meth pipe, digital scales, and clear plastic baggies. <br /> 57.Do Not Rent List. An accurate and up-to-date "Do Not Rent" list may have <br /> prevented this incident and would prevent it in the future. Ms. Ahn did not add this <br /> guest to a "Do Not Rent" list until Sgt. Bosman provided Ms. Ahn an updated list in <br /> July 2012. <br /> 58.Employee Monitoring. Police involvement should not be limited to those instances <br /> where the police are already patrolling the property. The frequency of incidents that <br /> arise out of police initiated contact suggest that many other incidents are not <br /> reported. If employees called 911 on all suspicious activity it would send a clear <br /> message to the Best Inn's current guests. Employees should not wait for Everett <br /> police officers' proactive patrols of the Best Inn to ask for assistance. <br /> 20 : <br />
