5 Page of DD I askeiif there were drugs inside her motel room. I observed-body language change, she began looking around and slumped her shoulders. then said "yeah theres some drugs in there". was patted for weapons and sat down with none being found. I did observe that she had a thick folded wad of US currency tucked into her front left pocket of her pants. While speaking with another female exited from room 112. I observed that as she exited she saw police and immediately turned to go back inside the motel room. Given that had just told me that there were drugs inside the room I instructed the female not to enter back in. She began to ignore me and go back inside and Officer Pountain contacted her. She was able to close the motel door, but did not re-enter it. She was identified as A check through dispatch showed to have an active SODA order preventing her from the 1100-4100 block of Broadway AVE and two blocks east or west. Dispatch confirmed the SODA order and I placed illander arrest. I advised=of her constitutional rights from m department issued Miranda card. She stated that she understood her rights and would speak with me. stated there was no one else inside the motel room. Given that was admitting to there being drugs inside the room, the initial narcotics complaint, the notorious history of this location and that a person who is so involved with drugs that she has an order preventing her from high drug areas had just exited the room I believed this motel room was being used for the use and sale of narcotics. I suspected that the vehicle and its occupants was contacting were there to engage in drug related activity. I then contacted the driver of the vehicle. I informed him that he was now being detained for a narcotics investigation. He was identified as I advisedof his constitutional rights from my department issued Miranda card. stated that he understood his rights and would speak with me. I asked if he was here j- visiting and he informed me that room 112 was actually rented to him. I then asked him to exit from the vehicle. I had ace his vehicle and asked him if he had anything illegal on his person or in his vehicle and he stated "No, you can search the me or the car, I got nothing" I then patted down for weapons. I noticed at his right front coin pocket that he had what appeared to be packaged heroin hanging out of it. I observed that it was a small clear blue baggie containing a brown chunky substance._was not handcuffed at this time and to prevent destruction of evidence I removed the item and observed that it did appear to be a small amount of heroin. I then placed under arrest for possession of a controlled substance. I asked about the heroin and he stated that he has just began to use heroin and that he smokes it. I asked who's drugs were inside the motel room and he stated that they belonged to=11. I asked how he knows_and he stated that she was his drug dealer. Officer Pountain then contacted the passenger of the car and he advised that through his interview with her he recovered a large amount of heroin and methamphetamine from her person. She was identified as and was also arrested. I now re-contacted I asked IMow much drugs were inside the motel room and what type._ told me that there was '/ ounce of meth inside the room. I asked her who the drugs belonged to and she stated "they're mine". I then asked-if she would sign a consent to search waiver allowing me to search the motel room. advised that she would give me consent to search the room. I then provide with an EPD consent to search waiver which lists her Ferrier warnings. I went over the waiver with nd she signed it I certify(or declare)under penalty of perjury under the laws of the State of Washington that the foregoing is true and correct (RCW 9A.72.085.)
