On August 19, 2016, the City issued the Respondent a violation citation for <br /> violations of International Residential Code (IRC) R105.1 Permit Required as <br /> adopted by EMC 16.005.010; International Property Maintenance Code (IPMC) <br /> 106.1 Unlawful Acts as adopted by EMC 16.005.010; IPMC 108.1.1 Unsafe <br /> Structures as adopted by EMC 16.005.010; IPMC 108.1.4 Unlawful Structure as <br /> adopted by EMC 16.005.010 and Everett Municipal Code (EMC) 19.41.030 <br /> Enforcement, Violation and Penalties. Copies were mailed to the Respondent via <br /> first class and certified mail to the Respondents last known address which Officer <br /> Cunningham obtained from Snohomish County Assessors Record. A copy of the <br /> citation was delivered to Mr. Lapinski Jr. on August 23, 2016. Each method of <br /> service used is independently sufficient to provide notice. On August 19, 2016, Officer Cunningham informed Mr. Lapinski Jr. that the <br /> basement of the residential structure was not to be used for sleeping purposes and <br /> that the missing smoke alarms should be installed immediately. (Exhibit#12, Email <br /> from Don Cunningham dated August 19, 2016) (Testimony of Code Enforcement <br /> Officer Cunningham) <br /> 8. On October 21, 2016, Deb Richards, property manager for the Respondent, <br /> informed Officer Cunningham that drawings would soon be submitted for permit <br /> application and that a request to reinstate the 2012 reasonable accommodation was a <br /> being sought. (Exhibit#13, Email from Deb Richards dated October 21, 2016) <br /> (Testimony of Code Enforcement Officer Cunningham) <br /> 9. On November 7, 2016, Officer Cunningham determined that the Respondent had <br /> not applied for or obtained the required City permits for alterations conducted on the <br /> residential structure on the property. (Testimony of Code Enforcement Officer <br /> Cunningham) <br /> 10. The City provided the Respondents with an opportunity to correct the conditions that I <br /> are in violation of sections of the EMC and provided notice of the date, time and <br /> place of this hearing. The Respondents appeared at the hearing. <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusions: <br /> CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> Pursuant to Chapter 1.20 EMC or any Everett Municipal Code (EMC) provisions that <br /> identify Chapter 1.20 EMC for enforcement, the Violations Hearing Examiner of the City <br /> of Everett has jurisdictional authority to hold this hearing and to issue the decision. <br /> EMC §1.20.020 <br />
