1 After opening Bids, if two or more lowest responsive Bid totals are exactly equal, <br /> 2 then the tie-breaker will be the Bidder with an equal lowest bid, that proposed to <br /> 3 use the highest percentage of recycled materials in the Project, per the form <br /> 4 submitted with the Bid Proposal. If those percentages are also exactly equal, <br /> 5 then the tie-breaker will be determined by drawing as follows: Two or more slips <br /> 6 of paper will be marked as follows: one marked "Winner" and the other(s) <br /> 7 marked "unsuccessful". The slips will be folded to make the marking unseen. <br /> 8 The slips will be placed inside a box. One authorized representative of each <br /> 9 Bidder shall draw a slip from the box. Bidders shall draw in alphabetic order by <br /> 10 the name of the firm as registered with the Washington State Department of <br /> 11 Licensing. The slips shall be unfolded and the firm with the slip marked "Winner" <br /> 12 will be determined to be the successful Bidder and eligible for Award of the <br /> 13 Contract. Only those Bidders who submitted a Bid total that is exactly equal to <br /> 14 the lowest responsive Bid, and with a proposed recycled m aterials percentage <br /> 15 that is exactly equal to the highest proposed recycled materials amount, are <br /> 16 eligible to draw. <br /> 17 <br /> 18 <br /> 19 COE 1-03.3 execution of contract.RTF <br /> 20 1-03.3 Execution of Contract <br /> 21 <br /> 22 Section 1-03.3 is amended by adding the following: <br /> 23 <br /> 24 The Contractor is required to possess a City business license prior to award. <br /> 25 <br /> 26 The successful Contractor shall obtain two (2) copies of the contract provisions <br /> 27 from the City Engineer after the project has been awarded by City Council. <br /> 28 These documents will have been prepared by the City Clerk (Sharon Fuller: <br /> 29 425-257-8610) for execution of the contract. The Contractor shall promptly <br /> 30 execute and return both signed copies of the prepared contract together with an <br /> 31 insurance certificate and additional insured endorsement as required by <br /> 32 Section 1-07.18 and a satisfactory bond as required by law and Section 1-03.4. <br /> 33 The City will forward 1 copy of the fully executed contract to the Contractor for <br /> 34 its records and the City will retain the other. The bond may be a combined payment and <br /> 46 performance bond; or be separate payment and performance bonds. In the <br /> 47 case of separate payment and performance bonds, each shall be for the full <br /> 48 contract amount. The bond(s) shall: <br /> 49 1.
