1 <br /> 2 If action to correct the listed deficiencies is not initiated within 7 days after <br /> 3 receipt of the written notice listing the deficiencies, the Engineer may, upon <br /> 4 written notice to the Contractor, take whatever steps are necessary to correct <br /> 5 those deficiencies pursuant to Section 1-05.7. <br /> 6 The Contractor will not be allowed an extension of contract time because of a <br /> 7 delay in the performance of the work attributable to the exercise of the <br /> 8 Engineer's right hereunder. <br /> 9 <br /> 10 Upon correction of all deficiencies, the Engineer will notify the Contractor and <br /> 11 the Contracting Agency, in writing, of the date upon which the work was <br /> 12 considered physically complete. That date shall constitute the Physical <br /> 13 Completion Date of the contract, but shall not imply acceptance of the work or <br /> 14 that all the obligations of the Contractor under the contract have been fulfilled. <br /> 15 <br /> 16 1-05.11(3) Operational Testing <br /> 17 <br /> 18 It is the intent of the Contracting Agency to have at the Physical Completion <br /> 19 Date a complete and operable system. Therefore when the work involves the <br /> 20 installation of machinery or other mechanical equipment; street lighting, <br /> 21 electrical distribution or signal systems; irrigation systems; buildings; or other <br /> 22 similar work it may be desirable for the Engineer to have the Contractor operate <br /> 23 and test the work for a period of time after final inspection but prior to the <br /> 24 physical completion date. Whenever items of work are listed in the Contract <br /> 25 Provisions for operational testing they shall be fully tested under operating <br /> 26 conditions for the time period specified to ensure their acceptability prior to the <br /> 27 Physical Completion Date. During and following the test period, the Contractor <br /> 28 shall correct any items of workmanship, materials, or equipment which prove <br /> 29 faulty, or that are not in first class operating condition. Equipment, electrical <br /> 30 controls, meters, or other devices and equipment to be tested during this period <br /> 31 shall be tested under the observation of the Engineer, so that the Engineer may <br /> 32 determine their suitability for the purpose for which they were installed. The <br /> 33 Physical Completion Date cannot be established until testing and corrections <br /> 34 have been completed to the satisfaction of the Engineer. <br /> 35 <br /> 36 The costs for power, gas, labor, material, supplies, and everything else needed <br /> 37 to successfully complete operational testing, shall be included in the unit <br /> 38 contract prices related to the system being tested, unless specifically set forth <br /> 39 otherwise in the proposal. <br /> 40 <br /> 41 Operational and test periods, when required by the Engineer, shall not affect a <br /> 42 manufacturer's guaranties or warranties furnished under the terms of the <br /> 43 contract. <br /> 44 <br /> 45 <br /> 46 1-05.13.RTF <br /> 47 1-05.13 Superintendents, Labor and Equipment of Contractor <br /> 48 (August 14, 2013 APWA GSP) <br /> 49 <br /> HOT MIX ASPHALT OVERLAY 2017 MARCH 2017 <br /> 14 <br />
