The Everett Municipal Code (EMC) 19.58.010(C)2 requires that day care <br /> centers and similar uses be reviewed pursuant to the Special Property <br /> Use section of the City of Everett. The standards and guidelines for <br /> review of the Special Property Use Permits are set forth in EMC <br /> 19.58.010(B)(1-3). They include: <br /> A. The proposed use must be reasonably compatible with other uses and <br /> potential uses within the general area in which the use is <br /> proposed to be located; <br /> B. The use must not have a serious adverse effect on the ecology <br /> and/or environment of the community; and, <br /> C. The use must serve the public convenience and necessity. <br /> 5. The mini day care facility has been used as a day care facility for <br /> 2-1/2 years and the Applicants have been licensed by the State of <br /> Washington for the use of this site. In addition, one of the Applicants <br /> has been licensed as a day care provider for twelve years by the State <br /> of Washington. <br /> 6. The Applicants have had a provisional mini day care center license for <br /> approximately six months. In order for this provisional license to <br /> become permanent, the Special Property Use Permit must be acquired. <br /> 7. On-site are three off-street parking spaces. In addition, there is an <br /> on-street marked parking area with three additional parking spaces on <br /> Beverly Lane. <br /> 8. The subject property is zoned R-2. As noted, the lot is a large lot <br /> with extensive depth. The property does abut six other residential <br /> properties. <br /> 9. Admitted at the public hearing, as exhibit 4, was a site plan. A copy <br /> of the site plan is attached hereto and by this reference is hereby <br /> incorporated as part of these findings. <br /> 10. As shown on the site plan, the day care portion of the facility is <br /> located near the center of the property. In the northwestern portion of <br /> the property is a garage and behind the garage is a yard in which there <br /> is a swing set. The yard extends to the northeastern portion of the <br /> site and throughout the entire eastern and southern portions of the <br /> site. The property is fenced. <br /> 11. A property owner to the north of the subject property indicated that the <br /> children at the day care center can be viewed from the second floor of <br /> the structure on that property. In addition, the noise from the <br /> children can be heard at that point. <br /> 7 ) <br />
