The letter writer <br /> submitted that their children use the day care center. They <br /> submitted that they use the driveway because it is the safest <br /> place to get the children from the car to the facility. She <br /> contended that Beverly Lane is populated with "a lot of traffic" <br /> and the safety of small children may be impacted. <br /> D. Letter dated October 12, 1989, from Valerie Kittleson. The letter <br /> writer submitted that her children are dropped off at the day care <br /> center. She submitted that traffic at pick up and drop off is at <br /> a minimum. <br /> E. Letter dated October 18, 1989 from Cindy Palmer. The letter <br /> writer submitted that her daughter attends the day care center. <br /> She stated that she uses the driveway because it is safer to do it <br /> than to park on the street. She submitted that the safety of her <br /> daughter is enhanced by the use of the driveway. <br /> 19. At the hearing an attorney for an opponent to the Special Property Use <br /> Permit submitted a letter of opposition on behalf of his client, Gloria <br /> Shapley. Drew Nielsen stated in his letter that his client opposes the <br /> application for a number of reasons. He indicated that because the <br /> residence on-site is vacant in the evening, no one resides in the <br /> premises. He submitted that the Applicants, Patricia and David Mumm, <br /> live at another house and the primary use of the subject property is <br /> commercial and not residential. He submitted that the commercial use of <br /> the property is inconsistent with the residential zoned designation. <br /> In addition, Mr. Nielsen submitted that the property is "in an unkempt <br /> condition". He submitted photos which he claimed depicted the unkempt <br /> condition of the front yard and rear yard of the property and the poor <br /> maintenance of the facility. In addition, the witness submitted that <br /> traffic on the driveway creates problems for his clients in the early <br /> morning hours. <br /> 20. At the hearing testimony was received from various witnesses. A summary <br /> of the testimony is as follows: <br /> A. Drew Nielsen - The witness, attorney for Gloria Shapley, submitted <br /> that the use the subject property as a mini day care center is not <br /> compatible with the residential nature of the surrounding <br /> properties. The day care use impacts the residents on the other <br /> properties because of the noise and condition of the property. <br /> The witness also submitted that the use is commercial and not <br /> consistent with the residential uses in the area. <br /> 7 ..,t <br />
