The Everett Planning Department recommended approval of the Shoreline <br /> Substantial Development Permit for the Bay Ridge Development subject to <br /> conditions that are set forth in the staff report which was admitted at <br /> exhibit 1 of this hearing. <br /> CONCLUSIONS <br /> 1. The application is for the approval of a Shoreline Substantial <br /> Development Permit per City Ordinance. 723-80, as amended, for <br /> development of property south of 23rd and 24th Drive S.E. and east of <br /> S.R. 527 in the City of Everett, Washington. The development proposed <br /> includes the construction of an 188 unit apartment complex on the gross <br /> area of 7.57 acres of land. <br /> 2. A Shoreline Substantial Development_„Permit is required per ROW <br /> 90.58.140(2) . The Permit is required because of the project's close <br /> proximity to Silver Lake; the development will occur on a shoreline as <br /> defined in ROW 90.58.030; and the development is a substantial <br /> development as defined in ROW 90.58.020. <br /> 3. The proposed development is a substantial development as defined in the <br /> Shoreline Management Act of 1971. Silver Lake is a shoreline <br /> recognized under the terms of the Shoreline Management Act of 1971. <br /> Accordingly, the Applicant must obtain a Shoreline Substantial <br /> Development Permit for the proposed development of the site. <br /> 4. Ordinance 1122-85, Section 7, as amended, establishes criteria for the <br /> issuance of Shoreline Substantial Development Permits. The Permit may <br /> be granted only when the development proposed is consistent with: <br /> A. The policies and procedures of the Shoreline Management Act of <br /> 1971; <br /> B. The Department of Ecology Shoreline Management Guidelines of <br /> 1972; <br /> C. The Everett Shoreline Master Program (the Snohomish County <br /> Master Program because the Everett Shoreline Master Program has <br /> not been amended to include the subject property) ; and <br /> D. The State Environmental Policy Act. <br /> With conditions of approval as set forth in this document, the proposed <br /> development of this site will satisfy the criteria of these acts. <br /> 000056 <br />
