Bay Ridge Development <br /> SMA 7-88 <br /> Page -13- <br /> 5. The City of Everett Ordinance #1122-85, Section 10-2, grants the <br /> Everett Hearing Examiner jurisdictional authority on the Shoreline <br /> Substantial Development Permit request. Ordinance 1122-85, Section <br /> 12(C) , grants the Everett Hearing Examiner authority to attach <br /> conditions, modifications and/or restrictions on the location, . <br /> character or other features of the proposed development that are <br /> necessary to make the Permit and development compatible with the <br /> criteria as set forth in Section 7 of Ordinance 1122-85. <br /> 6. In the Snohomish County Master Program the subject property is <br /> designated as an Urban Environment. With conditions, the development <br /> satisfies the goals, policies and criteria of the Urban designations as <br /> set forth in the Master Program. <br /> 7. Public access is required to Silvers Lake. Because of the development <br /> of the site and the dedication of the:land to the City, access will be <br /> provided. The proposed development is consistent with the Multiple <br /> Family Residential R.3.A zoning designation of the site. <br /> 8. The proposed development will be developed to a density of 24.9 <br /> dwelling units per acre which satisfies developmental standards. <br /> 9. Shoreline improvements, as proposed by the Applicant, include fill for <br /> approximately 600 cubic yards of washed sand, vegetation restoration, <br /> the creation of a boardwalk parallel to the shoreline and the <br /> dedication of property to the lake shore west of the S.R. 527. These <br /> shoreline improvements will not have significant impact on Silver Lake <br /> and will adequately allow public access to the site in a manner that is <br /> not detrimental to the environment. <br /> 10. The site contains a wetland area in the northeast portion of the <br /> property. Pursuant to the Department of Ecology review, no development <br /> shall occur on this wetland. However, a 25 foot to 50 foot variable <br /> width buffer with enhanced plantings and fencing that will isolate the <br /> wetlands will adequately protect this area of the site. <br /> 11. A detailed landscaping plan is required to provide for the aesthetic <br /> enhancement of the site. <br /> 12. Parking, as proposed by the Applicant, satisfies the parking <br /> requirements of the City. Any modifications to the site plan must <br /> include modification to parking in order to provide adequate number of <br /> spaces required in the Everett Municipal Code. <br /> 13. A limited scope E7nvironmental Impact Statement was prepared for the <br /> site. The limited EIS addressed traffic issues. With implementation <br /> of the specific mitigation measures, and adherence to them, the impact <br /> of the development of the site with regard to traffic will be mitigated. <br /> 000057 <br />
