• <br /> 000008 <br /> Bay Ridge Development <br /> SMA 7-88 <br /> Page -14- <br /> 14. The Everett Planning Department has recommended approval of the Permit <br /> subject to conditions. The public testimony has been noted in this <br /> document. <br /> DECISION <br /> Based upon the preceding Findings of Facts and Conclusions, the testimony and <br /> evidence submitted at the public hearing, and upon the impressions of the <br /> Everett Hearing Examiner of a site view, it is hereby ordered that the <br /> requested Shoreline Substantial Development Permit for the development of the <br /> Bay Ridge Development, south of 23rd and 24th Dr. S.E. and east of S.R. 527 in <br /> the City of Everett, Washington, is granted subject to the following <br /> conditions: <br /> 1. The Applicant shall provide all improvements as specified by the Parks <br /> Department including a boardwalk pier running parallel to the shoreline <br /> restoration of shoreline vegetation, starting at the water's edge by <br /> hydroseeding buttercup and smart weed. In addition, the following <br /> plants should be placed from the water to top of bank on 10 foot <br /> centers: 1) cattails, 2) burreed, 3) Rosa Rogsa, 4) Red Dogwood, 5) <br /> Red Elderberry. Some filling (approximately 600 cubic yards of washed <br /> course sand at 4 ,to 1 slope) to create improved habitat along the <br /> property's entire frontage on the lake shore shall also be provided by <br /> the Applicant. <br /> 2. The pedestrian access corridor (boardwalk pier) be designed in a manner <br /> to prohibit vehicle access for other than maintenance purposes. <br /> 3. All utility lines on the subject property shall be underground. <br /> 4. Any excess construction materials shall be removed from the shoreline <br /> area. <br /> 5. A plan detailing signage proposed shall be reviewed and approved by the <br /> Planning Department prior to issuance of any sign permit. The plans <br /> will be reviewed for conformance with the Snohomish County Shoreline <br /> Program and the City of Everett Zoning Code. Permits will also be <br /> necessary from the City of Everett Building Department. <br /> 6. The project must be developed in a manner consistent with the R-3(A) <br /> zoning regulations. <br /> 7. A detailed landscaping plan showing size, type and location of all <br /> plantings shall be reviewed and approved by the Planning Department <br /> prior to issuance of any building permits. This plan will also clearly <br /> indicate the evergreen trees to be preserved on-site and provide <br /> one-for-one replacement for any evergreen trees removed from the site <br /> during construction. However, upon review by the Everett Planning <br /> Department, this requirement may be modified if it can be shown that <br /> the evergreen trees are, in fact, detrimental to the development with <br /> the growth of excessive moss and the blockage of winter light. <br /> 000058 <br />
