D. Shoreline Access <br /> Finding: The proposed project site has approximately 4,800 <br /> feet of frontage on the main channel of the Snohomish River. <br /> Conclusion: Public access adjacent to the Snohomish River will <br /> be provided by the applicant. <br /> 3. Zoning <br /> Finding: The zoning of the subject property is Commercial/Industrial <br /> Flood Fringe which requires: <br /> A. The first floor of all structures to be two (2) feet above the <br /> regulatory flood protection elevation. <br /> B. The fill is to be two (2) feet above the regulatory flood <br /> protection elevation for a distance of fifteen (15) feet beyond <br /> all structure in any direction. <br /> C. Beyond fifteen (15) feet from any structure the fill to be no <br /> lower than one (1) foot below the regulatory flood protection <br /> elevation. <br /> D. Compliance with Federal Regulations Title 44 (CFR) Section 60.3 <br /> is also required. (Federal Flood Insurance Regulations) <br /> E. All dikes shall be constructed to be two (2) feet above the <br /> regulatory flood protection elevation. <br /> Conclusion: The proposed fill will be used to meet the above <br /> requirements when Phase II of the Park is developed and will be <br /> reflected in the conditions attached to any Shoreline Substantial <br /> Development Permits for park construction. <br /> NOW, THEREFORE, the Planning Commission recommends to City Council that <br /> based on the above findings and conclusions, approval of the Shoreline <br /> Substantial Development Permit for the City of Everett for the movement of <br /> 85,000 to 130,000 cubic yards of river dredge sand from the Sewage Treatment <br /> Plant construction site with the majority of the material to be stockpiled <br /> on the DNR dredge spoil disposal site and the remainder used to surcharge <br /> park building construction sites at the Langus Riverfront Park BE GRANTED <br /> with the following conditions which includes all conditions from DNS #28-89 <br /> for this project: <br /> 1. There shall be no encroachment of the fill into wetland areas. (SEPA <br /> Earth and Water Policies) <br /> 2. Any grading/fill on these sites shall be done so as to not create any <br /> sheer cliffs or impact the surrounding properties. (SEPA Earth, Land <br /> and Shoreline Use Policies) <br /> 3. The filled area to be surcharged for future park building <br /> construction shall be hydroseeded within 30-days of completion of <br /> fill in order to prevent erosion into adjacent water bodies. (SEPA <br /> Earth and Water Policies/City Drainage Ordinance 514-78) <br /> -4- <br />
