5 <br /> FINDINGS AND CONCLUSIONS <br /> 1. Shoreline Master Plan/Comprehensive Plan <br /> Findings: A portion of the project is in an area that was annexed to <br /> the City of Everett in 1986. Since the City Shoreline Master Program <br /> has not been updated to include this area, the Snohomish County <br /> Shoreline Management Master Program must be used for this area in the <br /> interim. The Environmental Designation under the Snohomish County <br /> Shoreline Master Program is "Rural," and utilities are permitted <br /> subject to regulatory controls. <br /> The City of Everett Shoreline Master Program designation for the <br /> remainder of the project is Urban Undeveloped and Rural. Utilities <br /> are permitted subject to general and specific regulations. <br /> Conclusions: The use is consistent with the Shoreline Master Program <br /> and all planning documents relating to the site. <br /> 2. Zoning <br /> Findings: The buried cable will pass through the following zones: <br /> R-2, Single Family High Density Residential; M-1, Heavy Manufacturing <br /> zone; A-1, Agricultural Use zone; and FWD, Floodway District. <br /> Conclusion: The utility use is permitted in these zones subject to <br /> regulations. <br /> 3. Floodplain Regulations <br /> Findings: The portion of the cable south of Lenora Street along the <br /> Burlington Northern right-of-way and that portion east of the <br /> railroad along the Lowell River Road are located in the 100-year <br /> floodplain of the Snohomish River and are regulated by E.M.C. Chapter <br /> 19.11, Floodplain Regulations and Federal Flood Insurance Regulations <br /> Title (24 CFR) Section 1910.3. The fiber optic cable will be buried <br /> and so will not require protection from or restrict or obstruct the <br /> flow of floodwaters. <br /> Conclusion: E.M.C. 19.11.040(C) and (D) permit utility transmission <br /> lines subject to Conditional Use Regulations which will be <br /> incorporated as part of this Shoreline Permit. <br /> 4. Environmental Impacts <br /> Findings: <br /> Earth: Trenching to install the buried cable to a <br /> depth of 42 inches with backfill to the <br /> existing grade will be the only disturbance <br /> to the earth. Public Works has reviewed and <br /> approved detailed plans for installation. <br /> Water: Burlington Northern Railroad right-of-way and <br /> the Lowell River Road portions of the cable <br /> route lie within the 100-year floodplain. <br /> The fiber optic cable will be buried and so <br /> will not require protection from or restrict <br /> or obstruct the flow of floodwaters. <br /> 15 <br />
