• <br /> dangerous to health and safety as determined by <br /> regulations promulgated by the Federal Secretary of <br /> Labor and the State of Washington. <br /> (3) Bonding - Where this grant exceeds $100, 000, the <br /> GRANTEE must provide the DEPARTMENT with both per- <br /> formance and payment bonds for the total contract <br /> price prior to the effective date of this grant. <br /> h. Environmental Requirements: The GRANTEE agrees to <br /> comply with all standards, orders, and regulations <br /> issued pursuant to the Federal Clean Air Act of 1970 and <br /> the Federal Water Pollution Control Act. <br /> 3 . COPYRIGHTS, PATENTS, AND TANGIBLE PROPERTY RIGHTS <br /> a. Copyrights and Patents: When the GRANTEE creates any <br /> copyrightable material (s) , or invents any patentable <br /> property, the GRANTEE may copyright or patent the same; <br /> but the DEPARTMENT retains a royalty-free, nonexclusive, <br /> and irrevocable license to reproduce, publish, recover, <br /> or otherwise use the material (s) or property and to <br /> authorize others to use the same for federal, state, or <br /> local governmental purposes. <br /> Where federal funding is involved, the federal govern- <br /> ment has a proprietary interest in patent rights to any <br /> inventions that may be developed by the GRANTEE. As <br /> such, the federal grantor agency, in the absence of <br /> legislation otherwise, will allocate patent rights in <br /> accordance with the "memorandum and Statement of Govern- <br /> ment Patent Policy" (36 F.R. 16887-16892) issued by the <br /> President on August 23, 1971. <br /> b. Tangible Property Rights: <br /> (1) Generally - The DEPARTMENT'S current edition of <br /> "Financial Guidelines for Grants Management, " <br /> Ch. 4, as supplemented by Part XIV of the "GRANTS <br /> MANAGEMENT MANUAL FOR GRANTS UNDER THE COASTAL ZONE <br /> MANAGEMENT ACT, " shall control the utilization and <br /> disposition of all real and personal property <br /> purchased wholly or in part with funds furnished by <br /> the DEPARTMENT in the absence of state/federal <br /> statute(s) , regulation(s) , or policy(s) to the <br /> contrary. <br /> (2) Personal Property Furnished by DEPARTMENT - Where <br /> personal property having an acquisition cost of <br /> $300. 00 or more per unit and a useful life of more <br /> than three years is furnished directly to the <br /> GRANTEE for use in performance of the project, it <br /> shall be returned to the DEPARTMENT prior to final <br /> payment.
