by setoff to the DEPARTMENT for use of such prop- <br /> erty. Should said property be lost, stolen, or <br /> damaged while in the GRANTEE'S possession, the <br /> DEPARTMENT shall be reimbursed in cash or by setoff <br /> by the GRANTEE for the fair market value of such <br /> property. <br /> 4 . CONVERSIONS <br /> The GRANTEE shall not, at any time, convert any equipment, <br /> property, or facility acquired or developed pursuant to this <br /> grant to uses other than those for which monies were <br /> originally allocated without prior written approval of the <br /> Director of the DEPARTMENT. Such approval may be conditioned <br /> upon payment to the DEPARTMENT of that proportion of the <br /> proceeds of the sale, lease, or other conversion or encum- <br /> brance which monies granted pursuant to this grant bore to <br /> the original acquisition, purchase, or construction cost. <br /> 5. COMPENSATION <br /> a. Amount: <br /> (1) DEPARTMENT Payment - The DEPARTMENT agrees to <br /> compensate or reimburse the GRANTEE a sum not to <br /> exceed $15, 000, together with $6, 429 of the <br /> GRANTEE'S matching funds contribution for the <br /> satisfactory performance of this grant. <br /> (2) Total Grant Value - The sum of the DEPARTMENT'S <br /> payment together with the GRANTEE'S matching con- <br /> tribution shall not exceed $21,429, which is the <br /> total grant value, including Washington State Sales <br /> Tax, where applicable. No additional payments <br /> shall be made under this grant unless otherwise <br /> specifically agreed upon in writing as an amendment <br /> to this grant. <br /> (3) Indirect Costs - Allowable indirect costs must be <br /> either (1) a federally approved negotiated percent- <br /> age, (2) a mutually agreed upon percentage rate of <br /> direct labor, or (3) an amount equal to 10 percent <br /> of direct labor. The rate agreed upon must appear <br /> as a specific budget item in the agreement. <br /> (4) Deviation from Budget - Payment will be disallowed <br /> when the GRANTEE'S request deviates from any of the <br /> budget objects in the project agreement by more <br /> than a cumulative five (5) percent of the total <br /> project cost without prior written approval. <br /> 4 <br />
