8 <br /> AND, WHEREAS, the following Findings and Conclusions were made at a <br /> public hearing on May 27, 1987: <br /> i FINDINGS AND CONCLUSIONS <br /> 1. Shoreline Master Plan/Comprehensive Plan <br /> Findings: The major portion of the project within the Everett City <br /> limits will be on Smith Island which was annexed to the City of <br /> Everett in 1984. Since the City Shoreline Master Program has not <br /> been updated to include this area, the Snohomish County Shoreline <br /> Management Master Program must be used in the interim. <br /> The Environmental Designation under the Snohomish County Shoreline <br /> Master Program is "Rural", and utilities are permitted subject to <br /> regulatory controls. <br /> The City of Everett Shoreline Master Program designates the portion <br /> of the project west and southwest of I-5 as Urban, and utilities are <br /> permitted. <br /> Conclusion: The use is consistent with the Shoreline Master Program <br /> and all planning documents relating to the site. <br /> 2. Zoning <br /> Findings: The project area east of I-5 is zoned Agricultural-Flood <br /> Fringe District (A-FFD), and the project area west of I-5 is zoned <br /> R-2 Single Family High Density Residential. <br /> Conclusion: The utility use is permitted in these zones. The fiber <br /> optic cable will be either buried or in conduit (along the bridges) <br /> and so will not require protection from or restrict or obstruct the <br /> flow of flood waters. Utility transmission lines are permitted at an <br /> elevation below the regulatory flood protection elevation. <br /> 3. Environmental Impacts <br /> Findings: <br /> Earth: - Trenching to install the buried cable to a depth of <br /> 42 inches with backfill to the existing grade will be the <br /> only disturbance to the earth. <br /> II Water: - A conduit will be attached to the east side of the I-5 <br /> li bridge to carry the fiber optic cable over the water. <br /> Air/Noise: - Equipment would emit exhause fumes and noise during <br /> construction. <br /> Land/Shoreline Use: - No change. <br /> Conclusion: The project will not generate long-term environmental <br /> impacts. <br /> 4. Public Access <br /> • Findings: The proposed improvements will be constructed in public <br /> right-of-way or easements. <br /> Conclusion: There is no opportunity to obtain public access since <br /> the applicant is merely using public right-of-way and easements. <br /> 59 <br />
