2. Except as noted, the Navy must comply with all conditions and <br /> requirements of the U.S. Army Corps of Engineers Record of Decision. <br /> The U.S. Fisheries and Wildlife/Navy accord on bald eagle perching <br /> piles is not adopted as part of this shoreline permit. If this is <br /> required as a mitigation measure for the Corps Permit, a separate <br /> shoreline permit must be submitted, reviewed and approved. <br /> 3. Shoreline and recreational improvements shall be provided to mitigate <br /> the loss of recreational opportunities caused by the elimination of <br /> public access to the East Waterway. Every effort shall be made to <br /> encourage the Navy, other waterfront property owners and the City to <br /> develop joint programs to provide public access. These improvements <br /> shall include, but not be limited to: 1 ) Fishing pier; 2) Access <br /> road improvements including pedestrian/bikeway improvements; 3) <br /> Viewing area or platform; 4) Parking; and 5) Restrooms or other <br /> mitigation measures acceptable to the City. If, within five years, <br /> the Navy, other waterfront property owners, and the City cannot agree <br /> on programs to provide for public access, the Navy will be <br /> responsible to mitigate its proportionate share (of public access <br /> improvements) which is sufficient to replace the loss of public <br /> access, as documented in the impacts identified above. <br /> 4. Debris booms shall be placed around the demolition and debris booms <br /> or other acceptable control methods shall be used at the disposal <br /> site. Silt curtains shall be kept on-site to be deployed to contain <br /> any debris. Care will be taken to minimize impacts on the microlayer. <br /> 5. Any debris deposited on the shoreline in the vicinity of the dredging <br /> activity or the dredge disposal spoils site that can reasonably be <br /> determined to result from activities of the Navy and their <br /> contractors shall be removed and the shorelines cleaned up and <br /> restored at the expense of the Applicant. <br /> 6. When separation or a break in the pipeline occurs, slurry pumping of <br /> the "clean" dredge material must stop until appropriate repairs are <br /> made. If the pipeline is moved from its original route, the Port of <br /> Everett, maritime operators and the public must be notified. <br /> 7. At the Navy's cost and expense, all navigational aids on the dredge <br /> disposal and pipeline sites must be maintained in good condition and <br /> repair. <br /> 8. Removal of submerged debris shall occur concurrently with the removal <br /> of dredged material. However, debris shall be placed in a separate <br /> barge for disposal upland. Generally any debris that has a rigid <br /> length longer than 10 feet must be removed for upland disposal. All <br /> debris which surfaces and remains floating shall be placed in the <br /> debris barge. <br /> 9. The spill contingency plan for fuel handling and storage facilities <br /> shall be implemented. <br /> 10. New storm drain outfalls are not permitted in the East Waterway. All <br /> existing storm drain outfalls from the Navy Homeport property shall <br /> be removed from the East Waterway by 1992. All runoff water from the <br /> Navy Homeport shall be collected and processed at pretreatment <br /> facilities such as oil and grease separators, to remove oil and grit <br /> prior to release into Port Gardner Bay, including the East Waterway. <br /> The oil and gas separators shall be serviced on a regular basis to <br /> maintain proper operating efficiency. <br /> 11 . The Navy shall conduct monitoring studies to evaluate bioturbation <br /> (movement) for deep burrowing organisms such as Axiopsis sp. and <br /> Molpadia sp. during at least the years 1 , 2, 4, 7 and 10 after <br /> disposal operations. <br /> -21- <br />
