d. Normal drainage patterns within the project area shall not be <br /> adversely affected by the conduct of spoils disposal; <br /> e. Notice shall be given to the City of Everett Planning <br /> Department in writing at least two weeks prior to the <br /> commencement of any disposal operations; <br /> f. Any spoils removed from the site shall be taken out of the <br /> flood plain unless they are used in a project for which a valid <br /> Shoreline Management Permit has been obtained; <br /> g. Existing vegetation on the outer edge of the site's dikes and <br /> on adjacent lands shall not be disturbed during the usage of <br /> the site. <br /> 3. The applicant shall maintain an on-site inspector to insure quality <br /> and proper placement of fill. At six-month intervals or upon <br /> placement of 100,000 cubic yards of fill material whichever is more <br /> frequent and again upon completion, a licensed and registered soils <br /> engineer shall provide documentation of physical, chemical, and <br /> biological quality of the fill material. This report should also <br /> address the compaction of the fill material. The applicant shall <br /> provide a bond or other acceptable financial commitment to remove all <br /> unacceptable fill materials as defined by the Department of Ecology, <br /> the Snohomish County Health District, and the City of Everett. The <br /> amount of the bond is to be determined by the Public Works Department <br /> prior to issuance of filling and grading permits by Public Works. <br /> 4. Prior to issuance of any fill permits, the applicant must provide an <br /> erosion control plan, including perimeter treatment and proposed <br /> surfacing, to the Planning Department and Public Works Department. <br /> 5. That the applicant shall provide a 50 foot wide pedestrian access <br /> easement adjacent to Union Slough. The specific improvements shall <br /> be approved by the Planning Department prior to application for <br /> building permits on the subject property. <br /> In addition, the applicant shall provide viewing areas on the <br /> waterward side of the Union Slough dike with the platform design to <br /> be reviewed and approved by the City Planning Department prior to <br /> installation. These platforms shall be installed at intervals to be <br /> established by the Planning Department prior to building permits <br /> being issued for the industrial development. <br /> These waterfront access requirements will be refined as a part of the <br /> State Environmental Policy Act (SEPA) review process prior to the <br /> construction of any buildings on the subject property. At a minimum, <br /> one pier access will be allowed for those water dependent activities <br /> occurring on-site. <br /> 6. That the site be filled in accordance with the conditions of this <br /> report, and that a minimum 50 foot wide wildlife riparian buffer <br /> adjacent to Union Slough shall be provided. This area shall function <br /> as both a pedestrian access corridor and riparian zone. All of the <br /> above improvements shall be in place prior to conducting a SEPA <br /> review of plans for the construction of more specific industrial <br /> buildings proposed for the subject property. <br /> 7. Detailed drawings in accordance with City design and construction <br /> standards shall be submitted to the Public Works Department showing <br /> site parking layout, landscaping, utilities, storm drainage, <br /> including a biofiltration system, temporary construction erosion <br /> control, and all required improvements in the public right-of-way. <br /> Public Works Department approval of these drawings is completed, <br /> approved and warranted before the Occupancy Permit is issued. <br /> -4- <br />
