6. Source of Fill <br /> Findings: The Applicant is proposing three sources of fill: <br /> a. The upper settling basin in the Snohomish River <br /> b. Overburden from Associated Sand and Gravel <br /> c. Other upland sources of clean fill material <br /> Conclusion: Upland sources of fill will be controlled through a <br /> Public Works Department permit issued by the City and the <br /> environmental review process. The quality of in-water dredging <br /> spoils is reviewed by the Environmental Protection Agency and the <br /> Department of Ecology. These permit processes along with ongoing <br /> control and monitoring by the applicant will insure that clean <br /> material is placed on site. <br /> 7. Access <br /> Finding: A new north/south arterial street will be required to serve <br /> the site. The applicant must dedicate 60 feet of right-of-way for <br /> this roadway corridor. <br /> Construction vehicle access to the site will be limited to this new <br /> north/south street corridor with the exception that construction <br /> worker access may occur at the existing 47th Street access if <br /> approved by Burlington Northern. <br /> Conclusion: By limiting construction vehicle traffic to the proposed <br /> north/south street system, the impact on the Lowell neighborhood <br /> street system will be minimal. <br /> After construction, the 47th Street access should be limited to <br /> emergency access only. <br /> NOW, THEREFORE, BE IT RECOMMENDED BY THE PLANNING COMMISSION TO THE EVERETT <br /> CITY COUNCIL, that the Simpson Paper Company Shoreline Substantial <br /> Development Permit for the 70.2 acre fill of approximately 450,000 cubic <br /> yards of material on the Lowell Industrial Park site located west of the <br /> Snohomish River north of Lenora Street be granted with the following <br /> conditions: <br /> 1. a. That the industrial park development for the subject property <br /> shall be reviewed and approved through a separate Shoreline <br /> Permit Hearing process after detailed plans for the site have <br /> been developed. This development shall consider the <br /> recommendations of the Draft Lowell Neighborhood Plan, Parks & <br /> Open Space Plan, A Pedestrian and Bicycle Access Plan for <br /> Everett's Snohomish Riverfront and the Shoreline Plan. <br /> b. Public access improvements will be identified during this <br /> process with a pedestrian/bikeway improvement to be provided <br /> the length of the property adjacent to the shoreline (outside <br /> 50-feet riparian zone). This trail would turn to the west at <br /> the 34-acre wetland on the north end of the property. <br /> c. The applicant shall provide an easement to the City for a <br /> public access corridor a minimum of 70 feet in width from the <br /> river to the west in an alignment acceptable to the City. <br /> (This agreement will be prepared by the City Attorney based on <br /> survey and/or legal descriptions provided by the applicant.) <br /> This property will be used for preservation of a 50 foot <br /> riparian zone, the installation of a 12 foot wide <br /> pedestrian/bikeway (public access to the shoreline to be <br /> provided in locations acceptable to the Department of Game and <br /> the City of Everett Parks and Recreation Departments) , and an 8 <br /> foot wide landscaped buffer between the bikeway and adjacent <br /> upland development. All the above improvements shall be <br /> installed by the applicant prior to occupancy of any structures <br /> built on the subject property. <br /> -3- <br />
