AND WHEREAS, the Planning Commission made Findings and Conclusions as <br /> follows: <br /> FINDINGS AND CONCLUSIONS: <br /> 1 . Shoreline Master Plan/Comprehensive Plan <br /> Findings: The subject property is designated Urban by the Snohomish <br /> County Shoreline Master Program (the controlling document in this <br /> annexed area) which permits fill in conformance with the applicable <br /> regulations. The Master Program also requires that fills only be <br /> permitted when used as preparation for an activity otherwise permitted <br /> by the Shoreline Master Program. The Shoreline Master Program also <br /> requires the City to have a dredge spoils management plan. One element <br /> of this management plan is to have disposal sites identified and . <br /> approved in advance of the dredging. This site provides the potential <br /> for containing 400,000 cubic yards of dredge material. * <br /> Conclusion: The proposed activity is generally consistent with the <br /> Snohomish County Shoreline Master Program and all planning documents <br /> relating to the site. <br /> * See Exhibit #6 for other applicable plans and regulations <br /> 2. Zoning: <br /> Finding: The property is zoned Flood Fringe Commercial/Industrial <br /> District. <br /> Conclusion: The fill proposed on the property is two feet above the <br /> 100-year flood elevation, which is consistent with the Flood Fringe <br /> District requirements and the Federal Flood Insurance Program. <br /> 3. Water Dependency: <br /> Finding: The site is not suitable for water-dependent use since water <br /> movement by barge on Union Sough is restricted by the Highwway 99 North <br /> roadway. <br /> Conclusion: Since the water-dependent criteria cannot be met, then the <br /> general public interest can only be met by providing increased <br /> opportunities for public access to the shoreline. <br /> 4. Environmental Impacts: <br /> Finding: The environmental impacts from the specific development of <br /> filling will be addressed in detail at the time specific information is <br /> provided on the source and quality of fill material. <br /> Conclusion: The State Environmental Policy Act (SEPA) checklist <br /> review process provides the opportunity for review and comment by <br /> interested parties at the development stage. <br /> 5. Buffer Zone between site and Union Slough: <br /> Finding: There is a need to provide an adequate separation' between <br /> the proposed Business Park Development and the water to minimize the <br /> impact on the existing dike environment. <br /> The buffer area needs to address both wildlife needs, the needs of the <br /> business park occupants, and the general public. <br /> General public access to the shoreline will be required in this <br /> development since the business park is not water-related/dependent. <br /> -2- <br />
