1 <br /> Charlotte Sey ,our Appeal <br /> Appeal 1-85 <br /> Page - 2 - <br /> FINDINGS OF FACT <br /> 1. On March 21 , 1985 , the Appellant requested a Home <br /> Occupation Permit for an in-home beauty salon on <br /> property located at 2505 - 81st Place S.E. , Everett, <br /> Washington. It was the intent of the Appellant to <br /> convert a bedroom in the residence on the subject <br /> property into a small in-home salon with a barber ' s <br /> chair and a single shampoo bowl. (Exhibit 1) <br /> 2 . On March 22 , 1985 , the / Everett Planning Director <br /> determined that the requested beauty salon was not a <br /> permitted use for a R-1 , Single Family Residential zoned <br /> property. The subject property was zoned R-1 , Single <br /> Family Residential. As a result of this determination <br /> the application for the in-home beauty salon was <br /> denied. (Exhibit 2) <br /> 3 . The applicant appealed the City of Everett Planning <br /> Department ' s decision of March 22 , 1985. (Exhibit 3) <br /> 4 . The subject property is zoned R-1, Single Family Low <br /> Density Residential . (Ervine testimony) <br /> Section 19.14 .020 of the Everett Zoning Code sets forth <br /> the permitted uses for R-1 zoned property within the <br /> City of Everett. Beauty salons are not a specified <br /> permitted use in this section. (Everett Zoning Code) <br /> 5. The City of Everett submitted that because beauty salons <br /> are not a permitted use in a R-1 , zone the Home <br /> Occupation Permit for the beauty salon should not be <br /> allowed. (Ervine testimony) <br /> 6. Section 19 .04 ,010 of the Everett Zoning Code defines <br /> home occupation as an occupation conducted on the <br /> premises of a dwelling unit or associated structures by <br /> the occupant. Section 19 . 44 . 010 of the Everett Zoning <br /> Code sets forth that home occupations may be permitted <br /> in any residential zone providing that general <br /> requirements are met. (Everett Zoning Code) <br /> 7. Section 19 . 44 .020 of the Everett Zoning Code sets forth <br /> the general requirements that must be met for Home <br /> Occupation Permits to be granted. They include : <br /> A. No noise , dust , smoke , glare or other <br /> nuisances shall be emitted other than is <br /> commonly associated with residential <br /> living ; <br />
