1 Charlotte Sey ,our Appeal Appeal 1-85 Page - 2 - FINDINGS OF FACT 1. On March 21 , 1985 , the Appellant requested a Home Occupation Permit for an in-home beauty salon on property located at 2505 - 81st Place S.E. , Everett, Washington. It was the intent of the Appellant to convert a bedroom in the residence on the subject property into a small in-home salon with a barber ' s chair and a single shampoo bowl. (Exhibit 1) 2 . On March 22 , 1985 , the / Everett Planning Director determined that the requested beauty salon was not a permitted use for a R-1 , Single Family Residential zoned property. The subject property was zoned R-1 , Single Family Residential. As a result of this determination the application for the in-home beauty salon was denied. (Exhibit 2) 3 . The applicant appealed the City of Everett Planning Department ' s decision of March 22 , 1985. (Exhibit 3) 4 . The subject property is zoned R-1, Single Family Low Density Residential . (Ervine testimony) Section 19.14 .020 of the Everett Zoning Code sets forth the permitted uses for R-1 zoned property within the City of Everett. Beauty salons are not a specified permitted use in this section. (Everett Zoning Code) 5. The City of Everett submitted that because beauty salons are not a permitted use in a R-1 , zone the Home Occupation Permit for the beauty salon should not be allowed. (Ervine testimony) 6. Section 19 .04 ,010 of the Everett Zoning Code defines home occupation as an occupation conducted on the premises of a dwelling unit or associated structures by the occupant. Section 19 . 44 . 010 of the Everett Zoning Code sets forth that home occupations may be permitted in any residential zone providing that general requirements are met. (Everett Zoning Code) 7. Section 19 . 44 .020 of the Everett Zoning Code sets forth the general requirements that must be met for Home Occupation Permits to be granted. They include : A. No noise , dust , smoke , glare or other nuisances shall be emitted other than is commonly associated with residential living ;
